New York Income tax question. I live in florida and just got a job working remotely for a non-profit in NY. In Florida there is no state income tax. but I noticed that when i get my check mailed to me that am getting charged New York personal income tax. Should I be getting taxed, being that I live & work in Florida?

- It is normal for a NY employer to withhold the state tax. File your federal return as normal. File a NY return as a Non-Resident and depending on how much you earned, you should get all of the state tax that was withheld back from NY.
- Income received from a New York corporation for services performed in New York State is New York source income and is taxable in New York State. You would in this case file a Nonresident NYS tax return (IT-203). If you are not PERFORMING these services in New York State, you need to contact the payroll dept at the non-profit and have them reverse the state tax withheld and re-issue a W2. This is the only way you can recover this money.
