Why would NY perform an audit and then tax me?
In 2005 I lived in Maryland and worked in DC. I got a letter from the NY State saying that I didn't pay New York State income tax in 2005. They're right. I didn't. Why would I? I didn't live there. So they are saying if I disagree I could give my explanation but penalties and interest will still accrue. Any ideas why?? I'm so perplexed. I still have my W-2's from 2005 (copies) wouldn't that be my income statements? I stayed with my parents in NY when I was sick for a little in February. But my official residence was Maryland. I had my office send check stubs to my parent's house for two months because my mailbox didn't lock and it was just the stub so I didn't need it but didn't want someone to get my SS#. Would that be why?

- Something is causing NY to think you had NY source income. I'd contact the IRS and get a copy of your income statements for 2005. That is the source of the data NY is using. So, go get your records. Do any of them have addresses in New York for you or your employer? NY has been arguing that telecommuting makes this NY source income.
- Did you work remotely for a NY company? Or did you live in NY at all that year? Or have a NY address on your federal tax return, or any of your W-2's? Or even if you lived there in 2004, they might not know that you had moved.
- it seems there auditing EVERYONe. i even got a bill in the damn mail. they really do wanna drive everyone outta this state
