Can I live in one state and claim residence in another?
I live in a state that has income tax. Can I change residence to another state without income tax and still maintain a home in my current state?

- You may have homes in two states but your primary residence is where you reside for more than 6 months, vote in, register your vehicles, pay utilities, have insurance including your health coverage, doctors visits, children attend school.. I maintained two homes in two states and both state taxing authorities scrutinized my paper trail to ensure I was following the letter of the law.

- No. A few pilots from Northwest Airlines tried this a few years ago. They had to pay back taxes to Minnesota plus penalties and interest. It was an expensive lesson to learn.
- No, state income tax does not work in that way. If you are present in a state and work there, you must report the income to that state (even if you are not a resident of the state). On the resident state, you must report worldwide income for the year included income reported to other states.
