  1. First of all, he can't "claim" you, a spouse is never claimed as a dependent. But you and he can file a joint return. And even if you don't file jointly, he can claim your daughter if he meets the requirements. You can't get info on his tax return if he filed separately from you. Any promises are between you and him, and the IRS isn't going to get involved.
  2. You will need to ask him that question. If he filed married filling joing, you would have had to sign the tax return too to submit it. If he filed as married filling separate the IRS will not give you any information in regards to his return, because you are not entered as a tax payer.
  3. If he filed a joint tax return with you as spouse then you would have the right to know the information on your tax return. If he used a tax preparation firm and you have a clue which one he used then the best course of action would be to call them and to ask for the refund information off of your tax return. Also you could ask them how your tax return was filed. Trust me I work in one and people are always calling and asking when their refunds are going to be coming in and how much their refund is so there probably will not be much thought of you calling and asking these questions. Once you know how much your refund is and if you know your husbands Social Security number then you could go to irs.gov and look at how when your refund is due. keetonsmom 13 year tax professional
  4. If it is a joint return, it requires your signature, so look at it (when you sign it) and see how much it is. If it is a separate return, he cannot claim you (spouses cannot claim each other on separate returns).
  5. OK, he can't CLAIM you, you filed a joint return WITH him. You were supposed to sign it, and you have a right to see it. You are bound by what is on there, too. You can request a copy from the IRS, takes time. Request a copy of the return, from him, IRS, preparer. You need a copy of your tax return for school, financial aid applications, some job applications, mortgage applications, rental applications, etc. Request a copy from him for one of these reasons, just normal thing. Without knowing refund amount, you can't use IRS websites Where's My Refund. You also need to know his SSN as return was filed with him as primary.
