How can someone stop an ex move out of state with children when it is stated in court papers that neither.....
parent is to move out of state. The parent that has sole custody told the parent with visitation today that when they get income tax back they will be moving several states away. Is there any action that can be taken now to nsure that the parent does not take off with the children? Any help would be appreciated. Both parents live in the state of Ohio the custodial parent is planning on moving to Georgia. HELP!!!!!!!!!!!

- I have custody of my son...I had to return to court to get a "move-away" signed even though I had SOLE LEGAL PHYSICAL custody! THey cannot move without the judge saying ok and the parents going to mediation! Though that is the law in CA! If the court papers say that you have cannot move away then they cannot! Without the court saying that it is ok....and they have to have a GREAT REASON to move! Like family, job, etc!
- court .. ask judge for an injunction. then if they do it anyway, you have to ask judge to issue a warrant for contempt of court.
- go to court when a parent moves with his or her child with out the parent having no idea thats illegal
- You need to call your attorney and give them the "heads up". But; the attorney probably can't file anything until the parent moves...but each state is different, so I'd call and let the ball start rolling...you may be able to prevent the move. Good Luck!
- If it's court ordered that niether parent move out of state then if you have time I'd go to court and file some type of motion, if you don't have time call the police and show them a copy of the most recent orders. That's illegal for them to move without permission from the courts.
- go to court but be careful if you are fighting the primary custody parent they might have a little bit more room to move if they won custody or were chosen by the child so talk to a lawyer first
- If it's a recorded court document they will be arrested.Call the cops when it starts to happen.
- Get an attorney to file for a hearing IMMEDIATELY. The parent that has visitation rights MAY be able to forestall this move. Once the custodial parent moves it will be too late due to the fact that parent will resides in another jurisdiction. DO NOT WAIT.
- I doubt if you can do anything right away but you may be able to get custody of your kids if you take the case to court. Ask yourself before you do it though what is best for your kids. Doctors agree that in early years, the best place (if a choice has to be made) is usually with the mom. You have to wonder why the judge chose the other parent to have sole custody apparently...
- Check with the cops and also contact the judge or the court that issued the papers. You may need to talk with an attorney, preferrably the one you used in your divorce case if possible, if not, contact any good local attorney or ask the court about free legal assistance if you can't afford an attorney's fee,
