State income tax filing: part resident in Virginia?

Hi there, my husband lived and worked in Washington state from Jan 07 to Aug 07. He then lived and worked in Virginia from Sep 07 to Dec 07. I lived and worked in Washington state from Jan 07 to Dec 07. For federal tax, we are going to file "Married, jointly". We don't need to worry about Washington state tax since there is not personal income tax there. However, in Virginia, there are income state tax for residents, part-residents and non-residents. My husband is still non-resident in Virginia since he has not changed his driver's license yet. I guess he will need to file part/non-resident state tax in Virginia for the income he earned while he lived there. Am I correct? Is it okay for him to file Virginia state tax individually and federal tax jointly with me? Will it affect the federal tax filing? Thanks a lot. Us as One: I don't quite get what you meant. Would you mind explaining it a little further?

  1. ask the i.r.s. for a copy of the federal law legalizing unapportioned taxes on wages, under the freedom of information act. i'll bet you find one doesn't exist. *edit* basically, there is no law requiring you to pay income taxes on labor. research it. that is VERY MUCH true. but you can still get in trouble for not paying them. :-( (sorry i couldn't be of any REAL assistance.)

  3. I'd ignore 'us as one.' Tax protesters are not going to help you do anything correctly with respect to taxes. Becca gave you a good website. The mere fact that your husband hasn't yet acquired a local drivers license doesn't make him a non-resident. If he's living and working in VA for month after month, he's very likely a VA resident, unless he's with the active duty military, ordered to duty in VA and then he'd be protected by the SSCRA (Soldiers & Sailors Civil Relief Act). It appears to me on the facts presented, he'd file as a part-year resident of VA. VA cannot tax his (or your) WA income, only what he made in the state of VA. How he files with the state doesn't impact your federal return. Hope this helps.
