Tax Forms from Employer?

I was laid off from a company in DC last summer. I moved away and now have another job. When I got my tax forms from the old company they had some of my income reported as living in Virginia, but I lived in Maryland the entire time. I asked them to correct this and the reply from was that this is common. This is the reply: "She said that your money has already been sent to the state of Virginia (right or wrong, they have it) and you need to file a non-resident tax return. As a non-resident you have no obligation to pay taxes, and you’ll get a refund. You may want to consider dong an “e-file” as I know I do that w/ my federal return every year & it processes even quicker, so that would allow you to get your $$ back from VA quicker. She said it isn’t that uncommon, so I can’t imagine any tax professional getting that much heartburn over processing it." Is this a big deal? I'm not sure. Are they responsible to correct this or should I just have to pay to file in another state.

  1. Sadly, if this is how it was processed while you were employed, yes, you're the one who has to get it corrected.
  2. They are responsible to report the information correctly...just tell her that if she doesn't correct it immediately you'll report the company to the IRS in which they will get a nice visit and an audit.
  3. No big deal...U will get a refund from VA and have to pay the state tax to MD. I have done this before when moving from one state to another...Some states may want you to send in a paper form and not e-file.
  4. since VA's tax forms are online, all it should cost you is a stamp and an envelope. File your VA tax return ASAP to get the refund before you file your MD return [which probably isn't due until April 15th and since you owe there's no reason to hurry and file early].
  5. First off the company needs to do a bit of self looking at the people who prepare their financial documents. You should have caught this at the time it was paid to the state of Virginia. My next question is did you do any work with this company In the state of Virgina? If so that is probably why taxes were pad to them. It didn't matter on where your actual state of residence was located, only that the work was done in Virgina and that is where they expect the tax to be paid. You should be able to download a tax form from the state of Virgina and file it yourself.

I used to work in Virginia and live outside that state.What your employer told you is correct.You just file your Virginia state tax return as a non-resident, and you'll get all the state tax money that was deducted from you back.You'll also need to file a federal income tax and a Maryland state tax return.H&R block or Jackson hewitt can help you file all these forms.
