Married couple living in two different states filing jointly.?

I live and work in Texas where they do not have state income taxes. My husband lives and works in Arizona where they do have state income taxes. We recently got married 3 months ago and are planning to file jointly in Arizona. How does that work out. He makes $45K and I make $32K. I have a house in AZ that is in my name only, he lives there, I still live in Dallas.

  1. For your federal return you combine your income and file a joint return. In AZ you would still file a joint return but only claiming his income as yours is from a state without state income tax.
  2. For that you need to check which is benefit. but my suggetion is file MFJ(marriege filing jointly) for federal and file as MFS(marriege filing separatly) for AZ state.
  3. Be careful as Arizona is one of ten community property states. Based on state laws, things can get tricky when trying to split the income. Arizona might hold that each of you share equally in the earnings (no matter who earned it). Worst case scenario - You earn all the income, your husband doesn't and you still pay AZ tax. Please consider consulting a CPA (and not just H&R Block) from AZ on this topic. Based on your locations, I'm sure there are many with experience to deal with this. Good luck.
