If I am employed in Massachusetts but live in New York do I have to pay income tax in both states?

Does this depend on how many days I spend in each state?

  1. sadly it doesnt matter the days spent in each state. you will have to pay for both.
  2. unfortunately yes, you should seriously think of looking for another job in the state you are living in, NY, which already taxes are sky high
  3. Unfortunately YES! I was in a similar situation, last year I was working & living in WA and FL(no state taxes in both states) where as my payroll was run from CA. I spoke to the tax consultant and they told me that I have to file taxes for all the states, one for earning income in that state and other one for living there. For doing this you will get a tax credit from both the states which will reduce your taxes a bit but still more than what you pay for one state. Also it depends on how many days you were living in each state. You might have to file resident or part-year resident in one and resident in the other state. Filing your taxes from any of those online tax programs should solve your problem...Good Luck!
  4. You will have to file a Massachusetts non resident return and a New York resident return. You will get a credit on the New York return for the taxes paid to Massachusetts.
