Do I have to fill out a 1040 form for a deceased taxpayer?

My mom died in December. She was 75, had social security and pension income. I've figured out the 1040 so far...it looks like she (we) would owe $91 to federal taxes. Do we need to file taxes for a deceased taxpayer? And from where would the $91 come from? And if we didn't file...anyone think the IRS would figure it out...and who would or could they come after?

  2. Yes, you need to file. The money should come from her estate. The executor of the estate (or personal representative) should make arrangements to have all taxes paid. You should check with her lawyer and see what the will says regarding an executor.
  3. I don't think you have to. And I don't think anyone will come after you. You may want to read the 1040 tax booket on this. I did'nt file when my mother died, and NOTHING ever happened.
  4. there is a special form to use for a desesed person, I dont remember what it is but thinking schedule K. Anywat make sure you do the form or irs will never leave you alone.

  7. sunshine is the best answer so far. You should review the IRS link she provided. The short answer is, if she would have been required to file had she continued to live, her representative has to file a final return. Even if the return in not required, I personally recommend filing just to inform the IRS no future returns will be filed.
