What is the New York State luxury tax on real estate? Is there a certain price when you have to pay additional taxes above & beyond the normal rates? If so, how much is it for NY State? Yes, I've already searched the New York State website section on revenue/treasury section. Sadly, it didn't provide the information. Sunny, thanks for the insights. However, do you know if there is a luxury tax on homes over a million dollars. I realize the more home the more taxes you will pay but I'm primarily concerned with the luxury tax.
Real Estate Transfer Tax in New York State NY - To be paid by seller or buyer? I am considering purchasing a home in Nassau County, Long Island (New York State). However, I would like to know if I am supposed to pay the Real Estate Transfer tax, or if the seller of the home is. The house is brand new construction, and we are purchasing it straight from the builder. Thanks.
pro-rated mortgage interest and tax deduction? i moved from from maryland to new york state at the end of october 2008 and i sold my home in maryland when i moved. i have claimed all of my mortgage interest and real estate taxes on my federal return. however, for my part-year-resident return in MD, they want me to pro-rate my entire deduction, even though i paid all of it while i was a MD resident. is it OK to claim all of the interest and taxes since i paid them all while i was a resident of the state? they want to pro-rate it to ~75%, which ends up being a difference of $150 in the refund. not exactly. i already took out my income from new york on line 13. because i was only a resident for 10/12 months, i have a use an "income factor" (see instr. #26 for form 502) to reduce the amount of my deduction by the fraction of income that i made outside of MD ($20K MD income / total income = 0.782). however, all of my deductions pertain to payments i made while a resident of MD, so i should be entitled to claim 100% of them, not 78%.
what is a real estate tax stamp? I live in New York state.? I am refianancing my mortgage, combining 2 loans and was told today I need to have $2500 at closing because of these tax stamps.

The state of NY holds deed to my house for back taxes, can the fed govt take the deed from the State? I am the executor for an estate where the deceadent owed property taxes and federal income taxes. The state of New York took the deed to the real estate associated with the estate while we are making payments to them for what we owe. My question is that the estate also owes money on back Federal Income Tax. Can the Federal Government take the deed from the state in this instance?

New Property and Taxes? We bought a small house and some property in Northern New York last year. We are billed quarterly for our local and school taxes based on our assessment, but I was curious about something else - A few (perhaps misinformed) friends did a lot of talking about "Oh, what about your state real estate taxes?" What is the Statute of Limitations for a total of $350,000 in Medical Bills on an Estate dated 2002-2003? My uncle died in December of 2002 with 350,000 USD in medical bills incurred within a two week period of time during that December. Due to previously owed propery taxes the deed to the Real Estate owned by my Uncles Estate was almost immediately taken over by the State of New York. Is it true that us Americans actually end up paying the same amount in taxes as socialistic wefare Europeans? I was reading this New York Times article about how the economic system works in the Netherlands, and their taxation rate (52%) is obviously far higher than ours (35%). But the article also says that income tax rate doesn't account for Social Security taxes, state taxes, higher real estate taxes, and health insurance taxes, which ends up driving our net tax rate up to 52% anyway. Is such an analysis true? And if it is, why do we pay just as much as the Europeans in taxes but get virtually none of the same services in return?
can we make a legal case to claim florida residency for my recently deceased grandmother? My grandmother was born in Arkansas but moved to Florida as a child. At age 16 she moved to New York, where she eventually got married and raised her family. While keeping their house in New York, my grandparents bought a series of houses in Florida during the time period of roughly 1970-1990. Their intent was to be primary Florida residents for financial reasons. My grandmother then gave legal ownership of the New York house to three of her children. My grandmother developed Alzheimer’s in the 1990's, she soon lost the ability to care for her and to understand what was going on. Her children had her brought up to new York to their old house, now owned by her children, to receive in-home nursing care 24 hours a day. She passed away last month and now the state of New York seems to be the state taxing her estate under the belief she was a New York resident. That is not what she wanted; her intent was to be qualified as a Florida resident. How can we go about fixing this????
State (not federal) inheritance tax question? In 2005, I was temporarily living and working in Michigan, but a legal permenant resident of New York, when a person in Florida died. I inherited $5000, which I received later that year, while living in NY and unemployed. I filed a federal 1040, an NY resident income tax return and a MI non-resident income tax return, and reported the income from employment in MI on all three. (I also claimed a credit on the NY return for the duplicate state income tax on the income from MI.) Do I have to report the inheritance to any of the three states, and to which states (if any) do I pay inheritance tax? (Do not worry about the estate taxes due to the federal government; someone else is responsible for that.) dk01237... is wrong. Inheritance is NOT reported on the federal 1040, for example. Bostonia... is probably right about the tax laws. He is wrong about what I knew when I asked the question. I never lived in Florida and was only in Michigan for a few months, so I do not know their laws well. However, this happened two years ago, so I might have known when I filed, and forgotten about it since then.

So why is it the American people allow our politicians to do the same things over and over and we believe them and expect results different from previous elections ? I've looked at the websites of current and previous candidates to get an understanding of their platforms. They all have positions, some of which I agree with , some of which I don't. But there is one thing that is missing from each and everyone of them, any manner of implementation. Health care, spending cuts, retaining or repealing tax cuts, keeping or removing troops, the soundbites with pretty numbers never end. Not a single candidate provides details on how exactly they are going to accomplish anything. Don't they realize that economists exists to make lottery ticket buyers look smart, not presidential candidates ? It reminds me of business plans I get from kids who tell me about their vision and project all kinds of numbers leading to grand results. They can site historical facts and figures, but when it comes time to get into details of exactly how they are going to execute on their plans, the response is basically that they will figure it out as they go. I wouldn't invest in a business that is winging it any more than I want to vote for a presidential candidate that is winging it. Unfortunately , they are all winging it. i have no question that they have every detail about how to spend their campaign contributions on advertising planned out. I have yet to see details on how they plan to accomplish all their great promises they are making to voters. That scares me. It also scares me that despite claims of not being an "insider" or wanting a different vision for America, every remaining candidate spends more energy campaigning to their party than to the issues. I got sick watching Clinton and Barack argue about who was less of a "Reaganite" during one of their few lively debate exchanges. I actually started to get a little bit excited about McCain. Then he went on the warpath to "mend his riff" with the Republican Party. I can only speak for myself, but the fact that he had a "riff" with the Republicans is exactly why i started to get excited about him. No, he hadn't presented any more details on his plans than any other candidate, but there was a glimmer of hope that he was a candidate that thought for himself. (And before all the comments start, Ron Paul is the worse of all the candidates when it comes to detailing how he would execute on his promises. Just saying you are going to cut and eliminate everything doesn't mean you know how to do it and/or could get it done.) So here we are, our country has the same problem we have every four years, our remaining candidates are politicians. They know how to spend other people's money. They know how to assign responsibility to someone else. They know how to beg for other people's money. They know how to campaign, schmooze and kiss babies. They have no earthly idea how to accomplish any of their promises. So here is my hope. My hope is that the entire primary process is just the preseason. That its nothing more than an expensive introduction to the Republican and Democratic candidates and once they have picked their winner, a wealthy individual will nominate them self to compete with the 2 parties and run for President. Are you listening Mayor Bloomberg ? For less than the cost of opening a tent pole movie, you can change the status quo . I'm not saying that I'm going to vote for you yet. Pension question involving Real estate? My husband recently left a job with a city police department for a state one. His new department recognizes his time served, and he does not have to contribute to the new pension system. Previously, he had, and is now entitled to get his other money back, after taxes and a penalty for pulling it out early of course. We were looking to use the pension money as a down payment on a home. My question is; is their some way to avoid any of the penalties usually involved with withdrawing pension money early, since the money is being deposited directly for a real estate down payment? There was mention of State and Federal taxes that would be owed as the money was invested pre-tax, and an additional 20% penalty because of out age (early 30's.) Any help would be appreciated. Carter introduced a bill Wednesday to eliminate all IRS penalties and interest for paying taxes past due. The legislation calls for the creation of what he calls the, "Rangel Rule," -- drawing attention to the recent legal issues of House Ways and Means Committee Chairman Charlie Rangel, D-N.Y., enabling citizens who fail to pay taxes on time to do so later with no additional fees. Rangel, who writes the country's tax policies, acknowledged last fall that he failed to pay thousands in real estate taxes for rental income he earned from a property in the Dominican Republic. As of September 2008 the Harlem Democrat reportedly paid back more than $10,000 in taxes but that did not include any IRS penalties. "Your citizens back home should have the same rights and benefits that come to you as a member of congress. You shouldn't be treated any differently under the law than your citizens back home," Carter said. He added that citizens should receive the "same courtesy" that the IRS is allegedly granting Rangel and Treasury Secretary Tim Geithner, who also recently acknowledged a failure to pay taxes. Carter penned a letter to Rangel earlier this month requesting that he either pay the IRS fees or join him in co-sponsoring the legislation establishing the rule. "As Chairman of the House Ways and Means Committee, I believe you set an example for all American taxpayers in your dealings with the IRS, and that you must do so in a way that enforces blind justice without regard to wealth or status," he wrote in the January 6th missive. A spokesman for the New York Democrat would not comment on the state of the tax issue, which is currently under investigation by the House Ethics Committee, but did respond to the Carter bill. "This legislation is unnecessary. Should we combine NYC and New Jersey? If you're from upstate New York then you know that we pay a ridiculous amount of taxes and way too much for real estate to support the black hole known as NYC! We pay subway taxes in upstate NY where NO subway even exists. Other states are making their moves, such as California proposing to divide up into 4 separate states and Texas wanting to secede from the union, so who else thinks that Upstate NY should be it's own state, because we would do SOO much better economically if we were, and that NYC and New Jersey should just be combined into one state?

Clinton] will not make up those numbers,” Clay said. “This race is over.” Which wouldn't have been true in any case--an additional 200 or so superdelegates would've still remained uncommitted, and Clinton and Obama would've been roughly tied among these party leaders.
