I am to be named sole beneficiary to a small, approximately 200,000 dollar estate, mainly a condominium, in the state of Florida. As sole beneficiary, what can I expect approximately in estate taxes both for the State of Florida and for the Federal Government? Please do not respond by saying "check with a lawyer,accountant,estate planner" or any other answer like that. Just looking for an EDUCATED answer based on current tax laws. My wife and I file separate tax returns, does it matter who deducts the mortgage interest on our 2 houses? Me and my wife will file seperate tax returns because during 2007 she lived and worked in Michigan and I lived and worked in Florida. We own a house in Florida and a house in Michigan. I make more money then her so I thought it would be beneficial to deduct the mortgage interest for both houses on my tax return. Is this OK? Who has rights to the deed and land? My mother parents names are on a deed for land in Florida. My uncle is name as the step-son on the deed as well. He was paying the taxes on it since forever. Before he died, I ask him if I could pay half on the taxes so I could put a house on the land. Of cousre he said yes. Four month later he died. My question is since my mother is the last sibling living and her parent names are on the deed, do she have any rights to the land? We have a condo in Destin, Florida? We have owned this condo in Destin, Florida for 15 years. It sits across the street from the beach where Pampano Joe's is on Old 98. Sell home and upgrade or Stay Put? My family currently lives in a 2350 sq ft 4/3/3car home in New Tampa, FL. The location is great as lots of retail development (malls, etc.) is forthcoming. The challenge is that we'd like to find a slightly larger home with more land to accommodate for our future family's growth. We're hearing that it's a buyer's market (good leverage for us looking to buy but not so good if we need to sell our home to buy a new one). Other complexity is the locations with more square footage and lot size in our price range are not near the modern retail conveniences we enjoy. Land/home prices have increased overall in Florida (as well as taxes and insurance). We expect that they will continue to do over time. We're wondering if we should take on a larger home (a small stretch) now vs. waiting five years and potentially find ourselves priced out of the market. For Real Estate Experts/Contractors? I was just wondering. If a person owns like 1 acre lot in a cheap Florida neighborhood and he wants to build a nice house (more like mansion) on it, what will be a rough estimate for total construction. I know an estimate cannot be decided until architect completes his work first, but just wanted to get an idea. The house will be about 10,000-15,000 sq feet on a 1 acre lot. The whole house will have a marble floor throughout and the house will be total of 2 floors (with high roofs for each floor) with inner as well as outer swimming pool. Also, according to the estimate (that you come up with), approximately what will be the property tax on it. The whole house is NOT 1 acre, but rather about 10-to-15 thousand sq ft on 1 acre lot. I want to know if real estate investment offers are legit? I have saved up some money while working overseas and have found some companies advertising on craigslist. I would like to run due diligence on them and to see if their offers are dependable. One is in Florida- and these sell condominiums. I have emailed some lawyers there asking them if they would be willing to check them out. However, I have gotten no response at all. The other one is in Georgia. The are advertising for credit partners. One co-signs mortgages or something like that and gets a profit after a certain time. I have run both through BBB but they have shown no record of them. I have emailed them and they simply said that they are not BBB members but they have a tax ID and are registered with Secretary of State. How can I run due diligence on both of these companies? Would it be wise to buy a lot of real estate in a depressed Florida housing market right now? Would it be wise to be a real estate vulture in Florida. I mean, the deals are there but a buyer may not see any return on his investment for many years if the economy continues at its slow pace. FLORIDA Homestead Exemption for "all" permanent residents? We are moving to Florida (the Palm Beach Area) from New York. My husband and I were under the impression that we would qualify for Homestead if we had a permanent, year round, residence in Florida. In Florida, why is the cost of housing shooting through the roof but the wages are still staying quite low? I know the answer. I just wanted to see if you did. The answer is that there is an endless supply of northerners that come to the state after selling their home. So real estate agents/ sellers in Florida can ALMOST charge anything they want. But those folks that move down here usually don't know the downside to Florida. They don't know how bad a hurricane really is, or that the cost of living down here is much higher than they thought, or that wages are low, or that crime can be very high, or that social services are not the greatest because od a low tax base, or that homeowners insurance is the highest in the nation, or that the sense of community is not very tight, or that the public schools rank quite low, or that etc... You can't really warn them beforehand. Gotta find out the hard way like me. It really isn't like Disney World. And also, employers always have an endless new crop of employees to choose from. Keeps the wages low.

At age 16 she moved to New York, where she eventually got married and raised her family. While keeping their house in New York, my grandparents bought a series of houses in Florida during the time period of roughly 1970-1990. Their intent was to be primary Florida residents for financial reasons. My grandmother then gave legal ownership of the New York house to three of her children. I want to know if I can claim cost of home remodel on house in one state after moving to another? We moved from Florida to Tennessee last year. We improved house in florida before selling. We did not live in Florida house for full 24 months so we are being charged capital gains. We were told we could not claim remodeling/repair costs of house in Florida. what type of tax is expected and how much in taxes should i expect from an estate inheritance? My estrange father died in 1997, lawyers from Florida contacted my brother about an inheritance that we have, I'm assuming from his estate (we currently live in Georgia). What is "Land Estate" Law in Florida? Before my mother passed away last year, she gave me an acre lot by... ..warranty deed in order to insure that my deadbeat stepfather could not get it. The title is now all in my name, but he lives in an old, filthy, trailer on it. A lawyer, in a "free" consultation, told me that I could not evict him, EVER, and could not even prevent him from moving his ex-wife onto the lot. Now I'm responsible for the property taxes and the well, septic, etc., and I can't even get a bit of RENT from this bum. The zoning won't allow me to build another structure for myself to live in. He's been sponging off of a bogus S.S. disability check of $800/mo. for years, but, has had $300 garnished to a back child support of $50,000, to another ex-wife, in another state and a $300 pickup truck payment Mother was14yrs. older than this dude, and worked 2 jobs, at times, to stay afloat until diabetes took her. I made the initial downpayment of $2000 in '90 for the lot, and paid her $100/week until she passed last Feb. I want this bum forced to sign a lease, pay rent, or to get out.

Short Sale in Florida. Does Buyer need an attorney? I am buying a house on short sale in Florida. There are 5 known liens put on the property, including unpaid taxes for the last year. I have a copy of HUD estimate approved by the seller’s lender. So I know all lien holders. I also can do the last minute search on the Internet right before the closing in order to avoid any surprises. In this situation, do I need a real estate attorney to make sure all liens are satisfied and I get the property with the marketable title? Or closing title company can handle all this issues? My real estate agent advises to hire an attorney for the flat fee of $1,000. Will it be a waste of money in Florida? Thank you! I guess, my question is What value will a real estate attorney add to the short sale process? I can search public records for new liens right before the close, make sure that they are satisfied at closing, and then check public records if my purchase is properly recorded. Strongly recommend getting an attorney for the buyers. Our attorney not only negotiated the fees but also make a lot of amendments to the documents. Saved us a lot of money. Tax Lien Investing? I am 25yrs old and have been researching the opportunity to invest in real estate. I work in the mortgage biz, so I have a decent backround in real estate. I was building homes in Florida but the market is to soft to build and sell quickly and turn a profit, there is to much uncertainty involved in this market. I currently live in New Jersey and have been very interested in buying tax lien certificates. I would like to be able to speak with someone who is better versed in this area. I'm kinda looking for a mentor type. I have been doing quite a bit of research and found this process varies state to state. NJ, NY, PA and FL are my areas of interest to start. I am looking at a house in N Florida? The seller of this real estate owns 2 houses side by side informed me that she wanted a clause in the contract allowing her to alter the property line. The lots are part of a soned neighborhood and I was wondering how the property tax can be altered so my taxes are not paying for the property on her side of the fence
Probate or quiet title action? Mom died intestate back in 1998, down here in Florida . I have been on record as being the title holder to the house ever since -- even tho her estate never went thru Probate. A recent title search resulted in a failure to establish the "chain of title" from Mom to myself. Since Mom's death the taxes have been paid by me; the mortgage is in my name; the deed on record shows that I am entitled to the property and has been on record since 1998. My options so far appear to be either proceed with a "Summary Administration" in the Probate Court; or, to file a "Quiet Title Action". Do I have any other options ?; and what would be the best choice to entitle me to the property?

Today Rick Campbell, one of our senior members at age 87, is here to reminisce a bit and give us a history lesson. He says he is so old that he learned to drive an internal combustion engine car (remember those) with a manual transmission. He once owned a typewriter. He remembers when bicycles had one speed, phones had two-party lines, and cameras had something called film. As incredible as this may seem, he says that when he was young, it was common for people to smoke in restaurants and public places. He is from a different time; almost a different world. I'm sure all of us are far too familiar with the tragic events of 2010, so Rick is not going to plow that fertile field again. Instead, he is going to give us a personal look back at the conditions which led up to that fateful year, in a speech titled "2010 Was Not A Good Year To Be President." "2010 Was Not A Good Year To Be President" Yes, 2010 was long ago and far away. As we look back on history, it appears that some Presidents had an easy ride- times of growth and stability. Teddy Roosevelt, Warren G. Harding, Dwight Eisenhower, Bill Clinton come to mind. Those were good years to be President. Others were elected just when the Republic was facing terrible crises: Abraham Lincoln, Woodrow Wilson, Franklin Roosevelt, George W. Bush. They rose to the occasion, even though they were controversial and widely hated while in office. Not such good years to be President. Just a few years prior, in 2008, the country began foundering. We were in the sixth year of the Iraqi Occupation, and the economy was flat. The mainstream press clearly wanted a Democrat elected. Although we didn't know it until some years later, oil producing nations had colluded to secretly buy their own oil on the open market, driving oil prices to shocking levels above the true demand price- reaching a high of $162 a barrel in October, 2008, just before the general elections. Their purpose was simple: to effect regime change in the United States. And of course, the U.S. economy was already in a real estate slump and also suffering the curse of stagflation; slow growth and high inflation. There were a million home foreclosures. Independent truckers went under by the thousands. Airlines failed. Airlines with names now long-forgotten: United, Delta, Northwestern, American. All now merged, of course, into the one lone U.S. carrier we love so much: Southwest. Against this backdrop of weariness of the war on terror, and economic distress, the American people were ripe for a demagogue, and they certainly got one in Barack Hussein Obama. He and his running mate Kathlene Sibelius inspired them with vague notions of hope and change; of a world in which diplomacy settled all international problems, of free universal health care, of abundant alternative energy, of peace and love. It was a vision too good to resist. The Republican nominee, a name you probably haven't heard in years anyone? Yes, it was John McCain, an obscure Senator from Arizona had no clue how to run a national campaign, and a platform nearly as liberal as Obama's. The selection of Condoleeza Rice as his running mate looked brilliant at first. Unfortunately, black voters viewed her as white, and women voters viewed her as one of the guys. Even so, the McCain/Rice ticket would have won the election if it weren't for the fact that 16 percent of conservative Republicans voted for anyone remember? That's right, Bob Barr, another name that's a footnote in history. After Obama's narrow win, thanks to recounts in Broward County, Florida, the country was positively giddy. A Democrat House, Senate, and President. At last an end to gridlock in Washington. Camelot! When Congress convened in January, 2009, the 44th President of the United States did something unique in history: he made good on his campaign promises. Certainly most Americans never really thought he was serious during the campaign. But whether because of inexperience, idealism, or simply incompetence, he followed through. In Obama's first One Hundred Days, the Congress passed his initiatives, and he signed them into law as he said he would. He repealed the Bush tax cuts, and increased capital gains taxes. He enacted a windfall profits tax, and instituted price controls on gasoline and diesel fuel. He passed universal health care, which added an additional 10 percent tax increase on all working Americans. He signed the Immigrant Amnesty bill which created 12 million new citizens instantly, each with entitlements. He closed the detention facility at Guantanamo Bay, and summarily released all the detainees. He repealed the Patriot Act, and cut funding for espionage, and eliminated all terrorist listening and wiretaps. Most important, he began the complete and immediate withdrawal of all American troops from Iraq. He ignored the advice of the Joint Chiefs of Staff, who wanted to retain bases in Kuwait and Qatar. Instead, he went with the recommendation of Secretary of Defense Dennis Kucinich, and ordered all troops back to U.S. soil. Viola! In One Hundred Days, by May of 2009, it was all done, and the vision was complete. He did exactly what he said he would do. And so it was in the summer of 2009 that things began to unravel for Obama. Of course, the economy needed a tax cut, not an increase, and unemployment quickly rose to 12 percent. Even attorneys and economists were put in the bread lines. Hard times! Price con! trols on gasoline immediately led to shortages and gas lines. The global cooling trend we have seen for the past 25 years first became obvious in 2009, exposing the CO2 global warming fraud. People were justifiably angry. Federal deficits increased massively because thousands of baby boomers, facing job loss and much higher taxes, simply gave up and took social security. Although the superb U.S. health care system was thrown into disarray, the bright spot was the creation of the Federal Department of Health care, and the immediate hiring of 250,000 administrators, inspectors and auditors, the only job growth in any economic sector in 2009. By February 2010, the U.S. military withdrawal from Iraq was complete. It was a very expensive undertaking. And then in March, the gradual Shiite insurgencies from Iran turned into a true Iraqi civil war. In May, Iranian tanks crossed the border and quickly took Baghdad. Although the exact number is not know, at least 230,000 Sunni Iraqis died as we stood by. Iran also quickly moved into undefended Kuwait. President Obama did exactly what he said he would. He sent Secretary of State, Maria Cantwell, to Tehran to meet with Iranian President Ahmadinejad. After two weeks of high level talks, the United States agreed to allow Iran to retain Iraq and Kuwait to create stability in the middle east, with the understanding that Israel would not be disturbed. Cantwell returned to Washington, and explained the agreement in her famous speech, in which she proudly noted that the Obama administration had finally achieved "peace in our time" in the Middle East. So there was some surprise at the rocket attacks on Tel Aviv on August 14th. President Obama said, "This is not the Mahmoud Ahmadinejad I knew." The Obama administration decided it would be de-stabilizing to take sides in the conflict, and approximately 29,000 Israeli civilians died during the summer and fall. American Jews were appalled at the inaction. Yes, in 2010 most American Jews were Democrats, but because of 2010, they are solid Republicans today. As awkward as it was, everything might have turned out all right for the Obama administration going into the fall mid-term elections of 2010, if it hadn't been for the dirty bomb in the Port of Long Beach. The administration had cut funding for the inspection of containers, because they felt it showed a "lack of trust" in the international trading community. It wasn't really a very big bomb, and thank goodness, not a real nuclear device, but nonetheless it contaminated some expensive real estate-Newport Beach, Palos Verdes Estates- and ultimately caused the death of 14,000 Americans. People were especially annoyed that Disneyland had to be closed for decontamination. And so, in the midterm elections, Republicans regained control of both the House and Senate, and the rest is history. The impeachment proceedings against President Obama for "failure to protect and defend" were swift and nearly unanimous. Vice President&nbs! p;Sibeli us resigned. Newly-elected Speaker of the House, J.C. Watts, became the 45th President of the United States. But you know the rest of the story well. Republicans finished the war on Islamic fundamentalists, largely by aiming ICBM's at Mecca and Medina. No Democrat has been elected President since. Republicans have held both Houses of Congress. History of Western Civilization and Economics are now taught in all public schools, and in English only. Marriage is defined as one man and one woman. And there are border fences, north and south. We old codgers remember the ancient Confucian curse: "May you live in interesting times." Well, 2010 was an interesting year, but it was not a good year to be president." (Far fetched? We are likely to find out if we continue to be unaware of the issues and vote with our emotions rather than be studious in our approach to electing our "public officials".) I've recently met a man that has offered to give me an up front lump sum of $10,000.00 + a 5 yr ( 60 month ) contract with payments of $2,000.00 monthly + a promise to close the purchase -standard mortgage- within 3 months of the 60th month. In the contract , I pay my homeowners ins. and prop. tax. I would agree to take $110K off today's price less my pmnts for ins. & taxes..about 30K so, I net 80K over 5 yrs and sell my home for 80K less I think it's a good deal for me as 1- I move to Florida...he gets my house w/o permission to alter home or property...he pays utilities...I ( or my agent ) inspects once monthly 2-at the sale, my cap gains are less & 3- the deal is off if my buyer defaults & 4- I have a 2 K per month income Am I crazy ? Is my buyer Crazy ? What are we missing ? Thanks for your time !

Capital letters Nearly a mile long and 40,000 on board - the first floating city Duncan Campbell in Los Angeles Saturday May 6, 2000 It may sound like something from a science fiction story - a floating city of 40,000 people that will slowly circumnavigate the globe - but the building of what will be the world's largest ship is about to begin. The Freedom Ship's creators say the vessel, whose constuction is due to start in Honduras this summer, will be one of the wonders of the world. The company behind the scheme said reservations for the 20,000 homes on board had begun to accelerate, and there were already plans to build two other floating cities. Freedom Ship will be nearly a mile long (4,320ft), 725ft wide and 340ft tall and will have room for 40,000 people, including a staff of 10,000. There will be a school and university on board, not to mention a landing strip, a hospital, a casino, a shopping mall and 200 acres of open space. The idea is that it will slowly travel the world, pausing a few miles out from chosen destinations such as ports or exotic tropical islands that can only be reached by sea. It will be on the move for 25% of the time and otherwise anchored off different ports. People who want to live on board can purchase their homes for prices which range from $150,000 (£94,000) for a small unit to $40m for something rather larger. There will be 20,000 units in total and the whole venture will cost $9bn. Developers are being encouraged to pre-purchase space and sell it on in the same way as their real estate counterparts do on dry land. "Already we have reservations for 15% [of the units]," said Roger Gooch, the marketing vice-president for the venture from his Florida office yesterday. "Once we are under construction, people will come running. It's already being termed one of the wonders of the world." Construction would start in "60 to 90 days", and would take three years to complete, with the shipyard operating 24 hours a day, he said. The ship is the brainchild of the project director, Norman Nixon of Engineering Solutions, an engineer from Arkansas who has overseen the construction of chemical plants and office buildings from Saudi Arabia to Texas. Application forms for workers on either the construction or staff of the ship when it is finally launched have been placed on the internet and talks are under way with the Nova Southwestern University to ensure that an established academic institution will be responsible for running the degree courses on the ship. Mr Gooch said that the hope was that the vessel would have a "global environment", with a large mixture of different nationalities and ages. It was not meant to be seen as a retirement cruise ship but one where people could run their businesses and educate their children. As a sales incentive, the company's material points out that there will be no local taxes to pay. So far, the greatest interest had come from Europe, with Germans and Scandinavians already paying deposits to secure their units. "We're just a giant landlord," Mr Gooch said, adding that anyone who wanted to start and run a business on the ship was free to do so. "We're not in the business of owning a barber shop or a restaurant. We're shipbuilders." There had been scepticism, he accepted, about the safety of such a vessel, but the company's engineers were confident that a ship of such a size would be secure and viable. But was there not a concern that the ship's size seemed to make it the stuff of which Titanic-style disaster movies are made, the vessel taken hostage perhaps by international pirates or the like? Mr Gooch said that a former FBI man would head a 2,000-strong security force, and the ship would be equipped with "state-of-the-art defensive weapons". The laws on board will be those of the country under whose flag the ship eventually sails - that country is still to be decided, but will not be the US, he said. Serious offenders would be held until the ship reached its next port and then surrendered to the authorities, he added. And will the city have its own government? Different decks and floors would be able to elect their representatives, Mr Gooch said, but "the captain's word will be final". can i force the sale of a real estate property if i am on the title along with 3 other people? (equal shares)? I am on the title to my family's property along with each of my two brothers and my mom. I want to move and get out what my share of the property is worth. can i take any sort of legal action to force the sale of the property? If so, who determines the sale price of the home, an appraiser? If not, can I put a second mortgage on the property due to my name being on the title? I just basically want to know what my rights are considering that I am not the sole title holder to the property. Thanks guys... p.s. the property is in florida, i am of age, i am the only one who pays the taxes and upkeep on the home.

State (not federal) inheritance tax question? In 2005, I was temporarily living and working in Michigan, but a legal permenant resident of New York, when a person in Florida died. I inherited $5000, which I received later that year, while living in NY and unemployed. I filed a federal 1040, an NY resident income tax return and a MI non-resident income tax return, and reported the income from employment in MI on all three. (I also claimed a credit on the NY return for the duplicate state income tax on the income from MI.) Do I have to report the inheritance to any of the three states, and to which states (if any) do I pay inheritance tax? (Do not worry about the estate taxes due to the federal government; someone else is responsible for that.) dk01237... is wrong. Inheritance is NOT reported on the federal 1040, for example. Bostonia... is probably right about the tax laws. He is wrong about what I knew when I asked the question. I never lived in Florida and was only in Michigan for a few months, so I do not know their laws well. However, this happened two years ago, so I might have known when I filed, and forgotten about it since then.
Should I sell my land and condo? I am in dire straits. I have bought two properties in 2005. I bought 1.6 acres of land for 38k and a condo for 100k. Both of gone down in value. My condo is located in st petersburg florida.(selling for 105k) My land is located in ridge manor florida.(selling for 42k) Been trying to sell both properties for a year now without any buyers. Too much on the market and the market is flat in florida. Shoudl I hang on for the next year? Or just reduce the price and sell and take a loss? I swear I will NEVER buy property again! ITS BEEN A NIGHTMARE! So many greedy real estate agents/brokers trying to get me into these properties telling me they are such great investments. Well now i want to go to law school and I cannot even sell them!! Im angry. Two things I have learned: 1.) Dont buy real estate if you cannot COMFORTABLY afford mortage payments along with RISING taxes and insurance. 2.) Dont buy unless you can sell property quickly. I need some suggestions? Should I take a loss? Hold on?
Can I get land back from eminent domain? I have found out that my deceased mom owned land in Florida. The taxes were deliquent since 98 and now the county owns it. I was a minor when she passed away, her estate had not been notified of the land during her will reading and such. The land to my knowledge was taken by eminent domain. Do I have any legal recourse to gain this land back or at least the $$ because of the fact that none contacted me or next kin to give us a chance to either pay the taxes or sell the property? Can the county take land that is owed by an out of state resident,,,the land address for mailing was my moms home out of state but once that house was sold and I was a minor there was no forwarding address given.
