How to fillout Top of IRS Form 1040 Schedule C? A small Consulting firm got a contract to do work for Marathon Oil. The Consulting firm asked me to work on the project. They paid me by check but did not deduct any $ for SS or Income tax. They sent me a 1099-MIS. The top of 1040 Schedule C asks for a company name. But I'm just an independent person, don't own a company. Should I just put my name in the "Name of proprietor" box and leave the "business name" box and the "business or profession" box blank?
On IRS form 1040 schedule C or C-ez, can I just give the income I made minus the expenses? I did a few carpentry jobs last year. If I add up all the labor and put this on the income, and the materials are all paid for to date, can I skip the expenses line? What I did was figure out how much I made then how much materials cost. I separated the two, so rather than add them both in section 1, cant I just skip the expenses in section 2 and only have an income with no expenses? Does this make sense?

Why is the IRS offering Form 1040 in Spanish? People who only speak Spanish are paid in cash, and their employers don't withold income taxes from their pay packets, so whats the point of making me wade through all of the Spanish versions of their online forms archive just to get the English ones?

Do I enter my contribution to my Roth IRA on line 15a or 15b on IRS form 1040? I'm new to IRA's and I opened a Roth for 2007. I contributed the max of $5,000. Do I enter that amount in line 15a (which I assume will not then be taxed) or 15b (which I assume will be taxed)? Also, can I file a 1040-EZ? I do not have $1,500 in taxable interest, but am wondering if by opening a Roth, I am ineligible to file the EZ form.
IRS form 1040 schedule D line 17 for stocks, yes or no? There are two categories, one for short term gains and the other for long term gains. I only have one entry of selling stocks for $40 profit within the year of 06. Line 17 asks if both are gains. One is +40 the other is 0, so technically both are positive/not losses. Or, you could interpret that both must have a positive entry other than 0. The answer determines if I need to complete the Qualified Dividends and Capital Gains Tax Worksheet or not. I'm thinking my entry is No, but I want to feel sure about it before submitting. The IRS Info page does not clarify the question.

With this information, how do I fill out my schedule D? What carries over from 2007 for short and long term? I did the worksheet for capital loss carry over and line 41 on my 07 1040 is (-8,337). I came up with (12,052) for my final number. This doesn't seem right. Note that all ()'s mean negative.

Tax withheld does not match IRS files VS entries on my 2005 Form 1040? Ok, I used TurboTax for my 2005 taxes. Now, I am getting a notice from the IRS where they are asking for some money back. When I entered my W-2 info, I did it automatically entering Employer ID that came on my W-2 and it pulled it directly (and correctly from somewhere) into my e-1040. I did my stuff and e-filed it successfully. Now, if I go and check back on TT 2005, I still see the same data, but by some reason the printed form and the summary one are actually displaying the discrepancy the IRS noticed. I've checked and re-checked my TT return and it is correct, but displays withheld incorrectly and sending it like that to the IRS and the printed forms. So, what are my options here? Anyone with the same problem? If so, how did you fix it with TT? Or am I SOL here? To clarify, seems to me like there is a bug on TT that is incorrectly displaying withheld on my return.

Form 1040-v - paying my tax to the IRS for $4.8K? I just did my tax for 2007 at H&R block and I have $4,824 due to the IRS. This was because I was on a 1099 for 6 months, and then later became a W2. Is it possible that I can pay that that off $1,000 monthly by check? How would that work? DOJ Dismisses Felony Tax Prosecution -- With Prejudice -- After PRA Defense Raised Evidence OMB Complicit In Income Tax Fraud DOJ & IRS Petitioned To Explain On May 12, 2006 in Peoria, Illinois, the attorney for the U.S. Department of Justice (DOJ) begged the court to dismiss all charges against IRS victim Robert Lawrence in federal District Court. The motion for dismissal came on the heels of a surprise tactic by Lawrence’s defense attorney Oscar Stilley. The tactic threatened exposure of IRS’s on-going efforts to defraud the public. The move put DOJ attorneys in a state of panic that left them with only one alternative: beg for dismissal, with prejudice. Stilley’s tactic paid off. Sixty days earlier, the DOJ had indicted Lawrence on three counts of willful failure to file a 1040 form, and three felony counts of income tax evasion. The federal Judge dismissed all charges with prejudice, meaning the DOJ cannot charge Lawrence with those crimes again. The trial was to have started on Monday morning, May 15th. On Wednesday, May 10, Stilley mailed a set of documents to the DOJ in response to DOJ’s discovery demands. The documents revealed to DOJ for the first time that Lawrence was basing his entire defense on an act of Congress, 44 U.S.C. 3500 – 3520, also known as the "Paperwork Reduction Act" (PRA). In Section 3512 of the Act, titled "Public Protection," it says that no person shall be subject to any penalty for failing to comply with an agency’s collection of information request (such as a 1040 form), if the request does not display a valid control number assigned by the Office of Management and Budget (OMB) in accordance with the requirements of the Act, or if the agency fails to inform the person who is to respond to the collection of information that he is not required to respond to the collection of information request unless it displays a valid control number. In Section 3512 Congress went on to authorize that the protection provided by Section 3512 may be raised in the form of a complete defense at any time during an agency’s administrative process (such as an IRS Tax Court or Collection and Due Process Hearing) or during a judicial proceeding (such as Lawrence’s criminal trial). In sum, the PRA requires that all government agencies display valid OMB control numbers and certain disclosures directly on all information collection forms that the public is requested to file. Lawrence's sole defense was he was not required to file an IRS Form 1040 because it displays an invalid OMB control number. Government officials knew that if the case went to trial, it would expose the fraudulent, counterfeit 1040. They also must have known that a trial would expose the ongoing conspiracy between OMB and IRS to publish 1040 forms each year that those agencies knew were in violation of the PRA. That would raise the issue that the Form 1040, with its invalid control number, is being used by the Government to cover up the underlying constitutional tort -- that is, the enforcement of a direct, unapportioned tax on the labor of every working man, women and child in America. Any information collection form, such as IRS Form 1040, which lacks bona fide statutory authority or which conflicts with the Constitution, cannot be issued an OMB control number. If a control number were issued for such a form, the form would be invalid and of no force and effect. Under the facts and circumstances of the last 24 years, it is safe to say that IRS Form 1040 is a fraudulent, counterfeit, bootleg form. Government officials responsible for this fraud should be investigated and face indictment for willfully making and sponsoring false instruments. Caught between a rock and a hard place, the DOJ and IRS decided not to let the Lawrence case proceed because it would reveal one critical and damning fact: The PRA law protects those that fail to file IRS bootleg Form 1040 The DOJ knew that it stood a significant chance of losing the case, and if that happened, the press and others would quickly spread the word, and leave only fools to ever file a 1040 again. Oscar Stilley’s pleadings and documents made these points quite clear: * IRS Form 1040 violates the federal Paperwork Reduction Act (PRA) and is therefore a legally invalid form. * Under the Public Protection clause of the PRA, no person can be penalized for failing to file a 1040 if the IRS fails to fully comply with the PRA. * The PRA statutes explicitly provide that a PRA challenge is a complete defense and can be raised in any administrative or judicial proceeding. * The IRS Individual Form 1040 has not and cannot comply with the requirements of the PRA because no existing statute authorizes the IRS to impose or collect the federal income tax from individuals. I would be getting my money back, but I sent my 1040 to the wrong IRS address (the address that you send to if you owe money, not get a refund). It's been two months and I've not got my refund from the IRS. What should I do? I did make a copy of my completed 1040 and original W2 form, should I send a copy to the correct IRS address? Do you check "Presidential Election Campaign" box on your income tax form? Why or why not? On the IRS Form 1040 (and alternative income tax forms), near the top of the first page, there is a line that reads: "Presidential Election Campaign: Check here if you . . . want $3 to go to this fund." In the instructions for the form (p. 18), this is explained further: "This fund helps pay for Presidential election campaigns. The fund reduces candidates’ dependence on large contributions from indviduals and groups and places candidates on an equal financial footing in the general election. If you want $3 to go to this fund, check the box. If you are filing a joint return, your spouse can also have $3 go to the fund. If you check a box, your tax or refund will not change." On the one hand, I can see where this might be fair, to help level the playing field. On the other hand, I hate the idea that presidential elections depend so much on money, rather than ideas; and my tax dollars may have better uses. So which box do you check, and what's your reasoning?
How to file address in Form 1040 under certain situations? There is a temporary worker from Fulton county, GA came by himself to South LA to work on a poject to rebuild Louisiana. He lived in Jefferson Parish a short while.(4 months,7months or 12 months what ever) However, this worker has family in Fulton and he returned to Fulton after finished the project. Questions: 1. When he filed income tax to IRS, should he put address in 1040 Form as Fulton? 2. Will it make the difference to for the filing if he stayed in LA for 4 months, 7 Months, or 12 Months? I filed tax form 1040 instead of 1040NR. How does this effect me? I have been in US for 3.5 years on F1(student) visa. I worked on OPT during August 2006 to August 2007. I hired a tax consultant to file my taxes 2007. The tax consultant used 1040 instead of 1040NR which I did not know at the time of filing. I realized that he used wrong form when one of my friends told me about it. Upon contacting the tax consulting, he replied me that I have been in for 3.5 years there won't be any problem as had met substantial presence test. While I was going through the IRS website, I came to know that there were some exceptions for substantial presence test. One of them is F1 status (student). Again I contacted my tax consultant and had brought the issue to his notice. He said that he considered my income (since I did job on OPT) was high, hence he filed 1040. I have a simple question about deducting property taxes on form 1040.? Greetings, I've always been able to figure out my own taxes with no problems or questions, but last summer I bought my very first home. As I puzzle over the tax forms this year, and what I can deduct, I have some questions: #1: Can I deduct on my 1040 A Form (Itemized Deductions) the property taxes I paid in November of 2007? The entire amount I paid? Really? For example, back in November I paid a total of $1,898.64 ($711.01 and then an additional $1,187.63 for the supplemental assessed values.) Is this all deductable on this form? If so, what I don't understand is when IRS eventually sends this same amount back to me, then it's like I'm not really paying these property taxes at all. (Not if I get the money back from the IRS.) That can't be right. I can't believe that my property taxes are all deductable. #2... How to I report income (from a 1099 MISC form) on my 1040? Essentially I have misc. income (classified) independent contractor from an odd job. The IRS website tells me to fill out a schedule 1040 C (or CEZ), then a Schedule SE for self employment tax, ok. I think I get that but the 1099MISC has only copies marked for state and recipient, how does the IRS know what I'm filing if there is nothing to attach to the 1040? Doesn't all income have to have documentation? -This is not the same as a 1099R.
IRS form 8379, line 8? I am filling out a Form 8379 Injured Spouse Allocation and have a question on line 8 (adjustments to income). Basically my wife had very little income last year so I paid her student loans and interest (the student loan interest nearly equaled her income). The student loan interest is showing up as an adjustment on my 1040. The tax prep software carries that over onto the 8379 and asks me to allocate it between the injured spouse (me) and the 'other' spouse (my wife). Which column should get this adjustment - the person who OWES the student loan interest or the person who PAID the student loan interest? I think we should add a voluntary contribution box to Form 1040 for people who think their taxes are too low? I keep hearing that prominent wealthy Americans think their taxes are too low. I am told by the IRS that we can now paid more taxes than required by law using the existing tax forms but maybe these prominent wealthy Americans don't know that. I am tired of hearing that Warren Buffet thinks Death taxes are too low. Then I notice he donates $42 billion to the Gates Foundation to avoid death taxes in the future and to deduct his charitable contributions in the present. My question is: Is it illegal in any way not to complete IRS Form W4 and the subsequent IRS Form 1040? If these forms are legally required what are the article numbers or code numbers to accompany such laws? What would happen to withholdings from pay periods if form W4 were not completed? Thank you in advance. I guess I was wrong for thinking that this was an open forum to seek help on certain issues however mundane, ignorant or infantile they may seem to certain 'Top Contributers'. Some of the answers to my question show the lack of humility that runs rampant in our 'Free Society'. Thanks fellow Yahoo users. What do they mean when they ask: Enter the amount of the student's (and his/her spouse's) income tax for 2006 (question 36): This information may be on the following forms: * IRS Form 1040 - line 57; * 1040A - line 35; or * 1040EZ - line 11. WHAT DO THEY WANT FROM ME? What form are the talking about? Would this be my W2 form? or would it be in the paper work that Jackson Hewitt did, and gave back to me, pplease explain as if explaining to a child! Roth IRA distribution before age 59 1/2 is taxable income? I'm doing my parents taxes. My mom for some reason decide to withdraw all of the money out of her Roth IRA. Well, now on her 1099-R sent by the bank, the distribution code is a J, early distribution from Roth IRA without known exception. I know she will get penalize that 10%, however, according to the IRS Form 1040 line 15 instruction. It said that the distribution is taxable unless the code is either T or Q. So it practically saying she will get tax on her distribution & get penalize 10% on top of that. My question is, am I reading this right? Roth IRA is your after tax money that you put in, why does the distribution become taxable now? Anything she can do to minimize this situation?
FAFSA question? I know they say you can file a FAFSA before filing tax returns, but I'm looking at the FAFSA and how would I be able to enter in some of the info (especially the worksheets A,B,C) w/o having the W-2, IRS 1040 form, etc? Then, someone told me you would have to update the information, but my parents told me they won't be able to file one or receive any of the tax forms until late February. So if it takes only a few weeks for it to get processed, how would I then be able to update the information?? Yes, I am very confused and I am a first-timer. Much appreciated for any help!!
