Any attorneys out there? Tax lien situation whereby IRS has garnished wages to the point of poverty; remedies? This info is for a freind whom has consulted w/ an atty. and stated that the only option is a settlement. This party does not have the money for a settlement nor enough assets to sell off to erase the tax liability. All wages garnished and personal asset(s) i.e. car has lien attached. Bankruptcy won't work due to this is non-dischargeable debt. This person understands the need to pay and has a good job-salary, but the IRS has left her/him with $333 to live on ea. month. Bascially poverty-stricken. No doubt the gov't has legal basis to due this, but, but, I believe it's unfair/ unjust to propel a person into dire straits with collection efforts. If the garnishment was not at the present level e.g. leaving this person with say $1000 to live on monthly, it would be affordable. I don't think the IRS... tax system, was setup to render a preson homeless or otherwise. Thank you for any assistance.
IRS tax lien statue of limitation? Stopped paying on my taxes in August 98 do to illness which left me disabled and on SSD. Ever since, the IRS has taken my refund every year of $2500. In Jan 2000 they put a tax lien on me which shows up on my credit report. One attorney told me to call them and ask for a hardship status and I filled out the paperwork last summer and I received a letter stating they were working on it. My lien is $7667. What I want to know is, does the 10 yr statue of limitation start from August 98 when I stopped paying. OR, does it start from the time they put the lien on in Jan 2000. Also, because they are taking my tax refunds every year, does that eliminate the 10 year statue of limitation altogether??? The lien will be off my credit report in Dec. 2009. Thanks for the help.

irs tax lien on home im buying? hi everyone. i was in escrow on a home. two weeks in, title report shows a $150,000 irs tax lien. sellers (equity firm) are working on getting it removed somehow. ive been waiting 5 weeks now. i guess the lien was applied to the previous owner who foreclosed. equity firm (seller) got the home and sold it to me. based on sales history, i show $238K as the last price..so i assume thats what hte sellers paid. just curious, what am i looking at here? should i give up hope the sellers will clear title? what exactly are they trying to do with the irs?are they trying to get the lien removed or will they ultimately have to pay off the 150K if they want to sell the home? im starting to lose hope here and will have to start looking for a new home to buy. IRS tax lien problems? a former employer did not remit employment taxes. The IRS has deemed me to be a responsible party and has started collection action. What is the best way to take care of tax liens (1 IRS, 2 FTB of CA)? These 3 liens were filed against me in 1993 - 1995. The 2 state liens have grown considerably. I can only imagine that the IRS lien has grown also. Is it best to talk to a lawyer? Or should I deal with the IRS and FTB directly? I see commercials periodically about reducing ones obligation. Is there a legal way to remove a tax lien against a home? My business partner and I purchased an investment home about 2 years ago. state tax lien? so i just checked my credit , and it says "state tax lien" it says it was reported on 9/08/2007. I received a letter from the irs regarding this issue on 9/15/2007 and agreed to a payment plan with them , the first payment was due on 11/15/2007 which was sent already . according to the person who i spoke to at irs, in 2003 when my taxes were claimed HR blocked claimed that i only made 20,000 for that year , Irs is saying that i made more than that. The store did well for awhile but I ended up closing it up and I owed money to IRS. His house was appraised at 107,000 with a mortgage of 93,000 (balance is 78,000). he isn't willing to pay more taxes than his federal withholding. I agree with him, I'd refuse to pay for wars orchestrated by this government. Food on the table is more important. The IRS gave notice of seizure on his property. He paid a few friends to burn the house down while he and my sister were on vacation (fire ruled accidental), and the insurance company paid off the balance of the house to the mortgage company (think he said he got some money too) before the IRS was able to legally "seize" the house. He cleared out his bank accounts, has all vehicles registered in my name, and gets paid under the table doing sales and commission. He makes about 3 grand a month now. Will he ever be able to buy a house again? IRS doesn't suspect foul play. The fire was started because of some "faulty" electrical inside the home...this is what I heard. He doesn't plan on rearing his head anytime soon. He has liquidated over 70,000 in assets and placed those in one of the relatives bank accounts. He is silently chunking away money in this bank account, and will continue to do so for years. He has essentially dissapeared under the radar. He is no longer at his current or previous addresses. He has no recorded employment for the IRS to garnish the wages. Basically, he wants to buy a house, but may end up living with relatives or renting the rest of his life. The IRS won't win this one. He only owes 8 grand in back taxes, penalties, and late fees. He only protests the taxes because he owes even more than his federal withholding. He already paid his taxes each month from his paychecks. Now he finds out he owes even more when doing the filing via turbotax. The dunning notices start, and he simply refuses to fund these wars and invasions. A certain somebody has tried unsuccessfully to invade/rebuild two countries. Spending in excess of 1 trillion dollars for the attempt. If you invest in a company who spends money with that reckless regard, would you want to invest any more money in it, or pull out right away? They say tax protesters use the constitution (no income tax is defined in the constitution) as their basis. Federal courts shoot down this argument. Why? They are affiliated with the Government. If he is smart, he will live with relatives or rent from a place that doesn't check credit (individual landlords who rent houses). He's got nearly 6 figures saved, and saving more under the table. He's good for a long time. I fail to see where I assisted him. I had nothing to do with the house fire. I had nothing to do with helping him hide, or paying him under the radar. I simply know of his whereabouts, and I know of his ventures as of late. It is not a crime to know about someone's delinquent tax issues, nor someone's ways of depriving the IRS of property that the IRS plans to steal from the individual. As for the 3 vehicles (all 2006 models), he gave them to me as gifts. I properly paid the gift tax on each car. He reimbursed me for the taxes and title fees. I fail to see how this is illegal. It was a legal gift transaction.
I had an IRS lien placed on me in 1996, how long can it last? My 2006 tax return showed a small refund due me, but when I got the check the IRS had withheld some of the money. This would have been the 1st time since the lien was placed that I was due more than a few dollars back. The original lien was then, and more so now, more than I'll ever be able to pay back. The money was a mere pittance to what I owe, but was very important to me. Is this what I'm to expect the rest of my life? I am a good person who made a regretable mistake years ago. It is severely depressing to think that this will be haunting me to my grave.
What to do about a Federal Tax Lien? Allright here we go, I am currently dating a girl and have been for over a year now. She was previously married. When her Ex and her were together they won a ATV ( worth about 6,000 ) or so. They didn't realize that you had to pay taxes on your winnings. They got divorced he took the ATV ( I believe it says he gets the ATV in the decree ) a couple of months after the divorce was final, they both get a Federal tax lien in the mail. He says he will take care of it but has yet to do it and probably won't as he seems to not care about much. We are looking to buy a house soon and I won't do it until she takes care of this lien as I know it attaches to property. Does anyone have any ideas or know the law on this? She has contacted the IRS but to not much avail. I would say she has as much right to the ATV as he since her name is on the lien to. Can she get the police involved to sell the ATV and pay off the lien? Any answers would be much appreciated. Thank you
If I hire a tax attorney, will this delay the IRS in taking collection actions, such as placing a lien? I owe about 8000 and can pay in a couple of months when I sell my house.
