I have a IRS lien filed against my Real Estate. How long do I have before the property is placed for auction? A lien was recently [July, 2007] placed by the IRS against a piece of Real Estate in New York that is owned by an Estate that I am the Executor of. IRS/Santa Barbara Bank & Trust? Ok..Here's another problem. The Irs website states that my refund will be deposited on 2-16. I originally applied for a Refund Anticipation Loan (through Santa Barbara Bank and trust) and was denied, and that my refund would turn into a Refund transfer. (they will collect funds then disperse them to my bank account. I checked with SBBT for my account status and this is what it said The IRS issues refund deposits each Friday, so your delayed deposit may not arrive until the following Friday. You may visit www.irs.gov to check the status of your refund. The IRS did not deposit funds to your account as originally expected. The IRS usually makes refund deposits within 9 to 16 days, but your deposit was not received within that timeframe. At times the IRS will delay a refund deposit by one week, so you may check back at this site seven days from now. If no deposit is made by then, you should contact the IRS. IRS question. Please help!? If someone hasn't paid their taxes and the IRS put a levy on your bank account but the amount in the bank still wasn't enough, can that person still call the IRS and make payment arrangements for the back taxes or they'll just keep on taking all the money in the bank account unitl all taxes are paid? This of course needs to be paid but how flexible can the IRS be if the person who owes the taxes is on a permanent disability and no means to survive except for the money she gets from SDI which is now being taken by the IRS from her bank account. She doesn't get much from SDI and it will take several months for her to pay the IRS even if they take all the money from the SDI. DRK1946 you are so correct. The reason why there were no notices because they mailing it to the wrong address and they are now reversing the levy on the bank account and putting back all the money.

The IRS said the scheme usually works by the victim paying the scam operator a fee for preparation of a false refund claim and possibly a percentage of any refund received. This is primarily due to schedule-D. I had filed one for 2003 but totalled all the transactions rather than writing every item line by line. Unfortunately I had moved in mid-2005. So IRS mailed out some kind of errata which I needed to have responded by August 2005. Since I moved, I never received this notice. IRS then sent a collections notice in 2006. For which I responded with a new schedule-D with all the details. But IRS keeps ignoring every time I send a correspondence. I have hired a CPA. But today I received another notice, then I called IRS, they simply said, "Sir, your time to file for a correction to schedule-D expired in August 2005. So you owe us more than $100K. We will collect from you". I obviously am going to call my CPA and ask him to follow up. But I wanted some help from someone who has gone through this. IRS problems!? I just got a notice from the IRS that I owe taxes from 1999. I don't know how this could be right. I called the IRS last year and asked them if I was good on my taxes and they said yes. So I have all this interest to pay now. Does anybody ever settle with the IRS on an amount that is less? Can the IRS nab these people? I worked for a Nightclub for over a year and a half and I, along with all the other employees were paid in cash at the end of every night. From the security staff to the bartenders.Never once has ownership ever asked for social security numbers or passed out 1099 forms. I am going to report them. But I have questions: 1.I can send it anonymously but if I put my name will I be kept anonymous to the club owners? 2. If the owners have other people on the payroll like family and friends (people who dont physically work there to avoid being flagged by the IRS can they still get caught. 3. IRS dictating what my withholdings should be? My employer received a letter from the IRS, telling my employer to change my withholding to zero, the letter stated that I am not entitled to claim the withholding I am claiming and the IRS is telling my employer to change it to zero - can the IRS do this and does my employer have to do what this letter said? Can the IRS take back my refund? Is it possible for the IRS to take back a refund they already gave me? My husband and I filed a joint return a few weeks ago, with a 3600 refund. The IRS website told me that a direct deposit in this amount was scheduled to be made yesterday (Friday the 16th). I called my husband yesterday (overseas in germany) to find out if the deposit had been made. He went to the ATM, checked it, and said that all 3600 had been deposited. Then he called me this morning and said that the ATM was saying that the money was not there anymore. Is this possible? IRS notice w/ refund check said amount is WRONG, but amount was RIGHT! What?? The other week, I got a $452 refund check for my Federal Tax Return. With it was a printed card from the IRS called "Notice 54, rev. January 2000 -- About your Refund Check." It said: "The amount of the enclosed refund check is different from the amount shown on your return. You should be receiving a notice in a few days that explains why the amount of the check is different and what additional information, if any, you may need to provide to the IRS." There was more text, but the jist of it is above. The reason I'm so confused is because when my accountant gave me hard copies of my tax returns (after e-Filing them), the amount of my Federal refund was shown to be $452. And that's the SAME amount that I received the other week on my refund check. So why is the IRS telling me there's a discrepancy, when there actually ISN'T?? On top of that, it's been about 2 weeks, and I never got the explanatory notice I supposedly would be getting "in a few days". WHAT is going on?

IRS are the good guys? Why does everyone hate the IRS? I don't get it. There was this person complaining on here earlier about having an online business that crashed in 2000 along with alot of other companies and as a result, he has to pay the government extra money every year with interest because he owes them money he was unable to pay because he had to declare bankruptcy. First off, if you go bankrupt, it's YOUR fault. No one else is to blame. Secondly, the government needs that money to pay for schools and other programs. The IRS is a good thing. I know that occasionally the IRS may fine people too much money and charge too much interest, but how do they expect people to pay them back if they don't take aggressive measures? Also, if you have a business, you need to incorporate it. This guy didn't do that. If company has400k IRS taxes due on 941 payments from 1998and co. is defunct and I buy co. will IRS negotiate? There is a defunct company that I wish to buy. The company has $400,000 of IRS taxes past due from the year 1998. The taxes are due to non-payment of payroll taxes to the IRS (form 941 filings). The IRS has a lien and judgement on the company which is no longer operating and is in mothballs. IRS taxes (Simple pay option) Deposit NOT yet in my account HELP!!!!? My e-file (IRS) tax application was accepted on the 11th but.. IRS Refund? The IRS says they deposited to my bank account on 1/25/08. My bank still does not see this deposit. I know I gave the IRS the correct information, because on the tax software I only inputted my bank information once, and my State refund has already went through. IRS should tax players items if they tax fan who caught ball? I have no problem with the IRS taxing the person who sells the ball Barry Bonds hit if he sells it. But isn't taxing it before its sold opening a can or worms? If they can tax him for its assumed value then why not tax players for the stuff they keep that has value if sold? Does the IRS question the person receiving gifts of cash? A person can give multiple 12k to anyone without being taxed but the question is does the IRS question the person receiving? A lot of people around me are getting married and (so will i in the near future) so naturally i am wondering what the maximum amount a person can receive before the IRS comes to the picture. IRS levied business bank account. What can be done? I've just spent the past 2 hours on the phone with a friend of mine. he owns a small biz and the IRS levied his bank acct, taking out his bank balance of $1400. He knew he owed the money but has had financial problems and just didn't think it would happen this fast. Now, his bank said they hold the money for 21 days and that it MIGHT be possible to have the IRS remove the levy and allow him access back to the $1400. The IRS has accepted your return. Due to a prior year issue or other obligation the IRS is indicating ........ I filled my taxes yesterday (2/1/08) (at hr block) and to my surprise I was not approved for a RAL; I thought that this was odd, b/c this was the first time I was denied the RAL. Anyway, I recieved a call back from HR block today saying my refund was denied due to federal reasons; they couldnt provide me w/ any info as to why. So I checked the status of my return on their website. I got the following message when I put in my social "The IRS has accepted your return. Due to a prior year issue or other obligation the IRS is indicating that your refund may be delayed. Please call the Treasury Department at 1-800-304-3107 for more details." So I called the above number and it was an automated system--I got a recording saying that my return would be offset b/c of a student loan I had through AES. I have payment arrangements on this loan (it is in collections) I didnt think they would still garnish my return? I'm positive that this has to be what it is. Any advice? Well, I called the IRS and it looks like the student loan was what it was. She said I should have the remainder of my refund within 3 weeks. I too paid for the RAL :(

If you do not report these winnings, the IRS will come after you for them if the amount is at all significant. But ... you can claim gambling losses to offset your winnings. Say you win 20,000 playing poker. You put the 20,000 on your return as gambling income. On a separate line in the return you claim 20,000 in gambling losses. Friends IRS Taxes done wrong- Need more info? Posting for my guy friend. He is 23 and works. His older brother (same mom, not dad) doesnt work. That family is a mess. Tax , irs mutual fund question? Hi out there, I received a notice from the irs that I owe more taxes for the year 2006. I invested in a mutual with after tax money on a monthy basis from 2004-2006 and sold in 2 increments $5000 and $4900. I realized only a small gain of about $300 but did not report the whole sale to the irs. Now the irs is stating i owe taxes on the whole amount $5000 and $4900. irs website say 02/12/08 will be refunded, NO DEPOSIT AS OF YET? I filed my taxes on 01/28/08, the irs website says you will have your deposit before 02/12/08 and thats today and i have not received nothing..when i called they say i have to give it the full 3 weeks..can somebody please tell me what the heck is going on..the irs rep says nothing is wrong with my return, no date set for deposit..just wait for the full 3 weeks if nothing then please give the irs a call... are they really that behind on processsing the returns or what..please help... no i do not owe child support..and they havent released the money for deposit yet either it just states that the money should be in your account by 02/12/08 when called the irs..they have no information besides still in processing....i think its a delay in processing the returns
IRS Refund? The IRS says they deposited to my bank account on 1/25/08. My bank still does not see this deposit. I know I gave the IRS the correct information, because on the tax software I only inputted my bank information once, and my State refund has already went through. What time of the day does the IRS usually release the refunds for direct deposit? How is it that the bank cannot see this deposit yet? Does anyone know how this works? I am getting worried....
TurboTax/IRS? Could there be any flaws in the TurboTax program or does the IRS check it before it goes to the public? My baby's father wants to claim our son as a dependent and there is an option on TurboTax that says that he can but when I went to the IRS website 1040 instruction sheet is says that the dependent has to live with you for 6 months out of the 2007 year before you can claim them. My son lives with me not his father yet he insists its okay because TurboTax has an option on there that says he can claim him even if the dependent does NOT live with him. I don't want to break the law (obviously) but he definitely thinks TurboTax is right and I'm pretty sure the IRS is. Should I call them and will I even be able to get through to speak to a representative or is it not even worth it? Does anybody have any experience in this? And no we have never been married.
Can the IRS take a money from a life insurance policy being paid to beneficiary? My father passed and left a life insurance policy to me (his daughter); I'm using it to pay for his funeral. Ignored the IRS for years... where to start? I have not filed my taxes in about 6 years... in that time i had a levy or two, but now I need to make things right. Should I call the IRS and throw myself at their mercy or visit a tax lawyer first? I don't have any documentation for those years either, and I know I would probably need it. (Example - the IRS used to double-count rent I received from rental property, and I dont have the 1099s to prove it now...) I don't know what alternatives I have, if any, because I truly fear not getting treated fairly (I used to get audited yearly before I "checked out"). Is the IRS able to Garnish your entire paycheck? I have just seen my paystub and to my horror I noticed a section labeled "Tax Lien". The amount payed equals my entire paycheck of two weeks. IRS Question? I worked in a war zone for 300 days. I lost my job at no fault of my own, was forced to come home and be unemployed. IRS form 1040 schedule D line 17 for stocks, yes or no? There are two categories, one for short term gains and the other for long term gains. I only have one entry of selling stocks for $40 profit within the year of 06. Line 17 asks if both are gains. One is +40 the other is 0, so technically both are positive/not losses. Or, you could interpret that both must have a positive entry other than 0. The answer determines if I need to complete the Qualified Dividends and Capital Gains Tax Worksheet or not. I'm thinking my entry is No, but I want to feel sure about it before submitting. The IRS Info page does not clarify the question.
How to pay 30k in IRS taxes and 4K a month in mortgage? Oh my gosh I was laid off 6 months ago and I just found out that my unemployment has run out. I also found out that my husband hasn't paid our IRS taxes since 2005 and we owe $30k. If I get a job the IRS will probably take my entire check forever. This is a nightmare. IRS solution??? I have been told by my employer that they are going to start deducting 100% of my paycheck until a $5000 bill is paid. This is termed a "levy". IRS tax help/sole propriorship THANKS!!!? I worked in Afghanistan as a contractor. Didn't make 330 do to a serious event. Will file an SS-8. My question is though, I formed a sole-prop. business for tax write offs. Unfortantely, I didn't form a bank account for it because I left Afghanistan before I could set one up. The IRS lost my tax return and I have a certified receipt. Can I sue them for negligence of federal property? I sent my tax return in via certified mail and the irs lost my return. They processed my payment that was with the return but lost the actual return and they are requesting I send it back in. IRS Audit for Amended Return? I have a small business (restaurant). My 2005 tax returns were totally off. Gross sales and COGS were off 110% ($50K to110K and 26K to 55K), and lots of deductions were not included. This is a family business and my brother did the returns and totally screwed up. The old 2005 return paid the IRS $350. With the amended returns, I'm going to be paying them $1300. The amended return numbers are pretty similar to my past returns. I'm really paranoid because I'm afraid this might trigger an audit

IRS audit... is my tax preparer liable? We've used the same tax preparer for many years. Nothing fancy, one of the big name franchise's. Without any major deductions or audit flags we've been selected for an IRS audit. My wife and I are both W-2 workers and collectively earn just under $100K/yr, claim standard deductions (mortgage interest, kids (no EIC), nominal business expenses -- less than $1000/yr for business supplies, lunches, etc... and some mileage for business travel in a car that I own, (less than 10K miles per year and I'm in B2B sales), no investment losses or non-standard or "creative" deductions). Just seems so odd that we'd be selected for an audit. Is my tax preparer accountable to me for this audit? Is selection totally arbitrary or, are certain flags looked for? Appreciate all the feedback. Yes, business expenses are unreimbursed, mileage claimed is mileage not paid by my employer for business travel in my own vehicle. And, perhaps "liable" was a poor choice of words. I think "accountable" is probably better. Just seems we pay a fair premium for sound advice in completing our returns and advising us on what we should include and what not to include (so to speak). I'd like to believe I've paid for a bit more than someone simply filling in the blanks with the info I've provided. Wouldn't be much of a service if that were the case.
IRS question? This is just an argument me and my friend had, not related to my own life. If you have a live in girlfriend or boyfriend and she is cheating on her taxes and gets caught (she owns her own business and didn't file taxes for it) can the IRS take your home that's under your name. IRS didnt pay close attention, and now they want the money back? Ok, so in 2005 I did my moms taxes on turbo tax, but my step-dad did his taxes on paper. Somehow one of there kids got claimed for child tax credit on both. The IRS issued the refund as stated on the return, but now they are telling my mother that she owes the money plus fees. Shouldn't they be responsible for giving the refund. they are still together but not married. After reading the information, there reasoning for my mom being punished is that my step-dad made more money and was entitled to the tax credit. Thank You
IRS? If I earn only $45 per week tutoring (I work for myself now) is that under the IRS earnings threshold? I live in Southern Cali (I have no car folks, lost my car in a car accident in 2003) and I had to start working somehow. So, I started tutoring to make a few dollars come in...less than $200 a month. I was told from H&R Block that if a single person earsn less than 6K or 5K a year, then that person does not have to report those earnings to the IRS. What happens if you earn $180 a month-or 2K a year? What about unemployment? What will they say? it's not like I'm rolling in the dough and I don't have my own transportation. Yes--I'm looking into car pooling, but-that is a different question. If you want to criticize me-please do it some place else. I didn't come on this to get that.
Should the IRS, SS & ICE departments all share information? It seems that if SS told the INS where all the no-match letters went, it would be easier for the IRS to go after employers who knowingly hire people w/o papers. Likewise, if all the ITIN mortgages were checked against IRS records, I bet you'd find a lot of "undisclosed" income. How is it legal for a bank to make a loan on a house that the mortgagor isn't even allowed to live in? (Yes, mortgagor is the proper term, the mortgagee is the bank).
Can I claim the difference between the IRS standard and my actual corporate travel reimbursement? I've been doing a good amount of business travel lately. My employer reimburses mileage and provides a per diem. However, both those amounts are below the standard IRS rates. For instance, the IRS mileage deduction is $0.485 per mile, while my company reimburses $0.405 cents per mile. The IRS per diem for the region I travel to is $44 / day while my company pays $35 / day. When I file my 2007 taxes, can I claim the difference between the allowable and actual reimbursements and an unreimbursed business expense? I travelled 2,000 miles for business, so was reimbursed $810. At the IRS mileage rate, that would have been $970. Can I claim the $160 as an unreimbursed business expense? Is the scenario different for mileage and the per diem? I'd prefer answers from folks who have actually faced the situation (or tax specialists) rather than speculation. Many thanks!

I am on a payment plan with the IRS for my 2006 tasx returns but I may not have enough to make this months payment if it goes into default can it be brought back to good standing? IRS saying my fiance has to prove paternity? My fiance has three children. They have lived mainly with him since they were born, with their mother coming and going, always leaving the kids with him. After moving out, she would take them for a week or so at a time. Anyways, he is being audited for 2004 since the mother's boyfriend claimed them on his tax return and she received government benefits claiming the kids lived with her. We've sent all requested documents (birth certificates, deed to home, letter from school, medical bills, etc.) to the IRS, and so far none have been acceptable. They are now asking for him to send a mortgage statment, utility bills, complete school records, complete medical records, and the long birth certificate. The biggest obstacle he faces is the kids have her last name and she didn't want him listed on the birth certificate. Only one child was in school during 2004. Has anyone ever had a similar problem? Maybe you work for the IRS and have some suggestions.

IRS & Direct Depost? According to the IRS's Where's My Refund website, it says my refund was direct deposited to my account on the 16th, last Friday. I check my account balance with my debit card and it doesn't show any new money. As today is a holiday and it happened on a Friday, possible Friday night, do you think I'll have it in my account tomorrow? I bank at a small credit union, does someone at the bank have to actually credit my account? How does it work? Your tax refund was direct deposited on February 16, 2007. That is all it says... The guy at Turbo Tax said it should say more, but, I guess it doesn't? He was confused himself.
