Exempt From Some Federal Income Taxes Knowledge Base

Is income earned overseas exempt from US Federal Taxes? If so, how do you do it and why? We are having a discussion here at work and was wondering what is the correct answer. I understand, you still have to file 1040 but will you get back your withholding tax? Some say that is not true while I say it is. I'm sure the "free income" only happens to a certain type of people.

Can I claim exemption from federal taxes for 2 paychecks + then return to normal allowances? read on..? I have, in the past, changed my W-4 form to reflect my choice to remain exempt from paying any taxes for just a few pay periods, thus receiving entire gross pay. Anyway, I THINK this is what I have done....I believe that the qualifications are that I had to pay no federal income tax last yr, which I did not. The form DOES state that I would expect no tax liability for this yr as well, which is not true, but I have still done this in the past without problem in the same circumstance since most of us DO have to pay federal income taxes. Can anyone knowledgeable give me some guidance here? I tried to call the IRS but they are only M-Fr hrs. I also need help with the form. I know to write "Exempt" on line 7, but am unsure if I need to write any numbers anywhere. I know I have posted this in the wrong category, but I have also posted it in the taxes categories. I put it here as well so more people will see it. Thanks.
Do I have to pay federal taxes? I am 17 years old and at my job i was exempt of paying federal taxes and when I got my W-2's it said I would be getting nothing back since my federal income tax was with held. I tried to file them anyway to see if I was eligible for the stimulus check or whatever it is called and it stated that I owe 90 some dollars to federal or whatever. I only made $6396.10 at the job and I heard if you made under $8750 you do not have to pay federal. If someone could give me some more information and show me where they got it from I would be very appreciated. I live in Maryland by the way if you need to know.

whats that one law where college students are exempt from tax? i was talking to a guy and he said that there is some federal law. something like because he was in college he did not have to pay income tax
If I paid my share of the national debt, could my income remain tax free for life? the US national debt is about $12,658,000,000,000 and there are roughly 307,000,000 Americans, so my share would be about $41,231 and some change. If I just wrote a check for that amount to the US treasury, would the government exempt me from all federal tax for life? I think it would be a great idea!
Is my income (through federal grant) exempt from federal income tax? I currently am employed part-time by a professor at a local univeristy. She does a lot of domestic and overseas humanitarian work and gets Federal grants for her work. I am paid through this federal grant. I have noticed on my W-2 that absolutely NO federal taxes were taken out of my income. State and local taxes were taken out. Am I exempt from federal taxes because of my income source? Although I am paid with money from the federal grant, the checks are actually cut by the University. It is a public university, and I can't figure out why else federal taxes wouldn't be withheld. I am single, and I'm filing a 1040-EZ. Hmmm....I wonder...Could I possibly not owe any? I'm still claimed as dependent on my parents' taxes, and although I work full-time and made $12,000 at that job, I only cleared $3,000 at my part-time job that I am wondering about.
Why are Democrats proposing to raise taxes, but only on Red States? How is this fair? http://online.wsj.com/article/SB10001424052748703294904575385060539126410.html?mod=googlenews_wsj http://www.washingtonexaminer.com/opinion/blogs/beltway-confidential/democrats-want-to-raise-taxes--but-only-on-red-states-99954334.html residents of high-income, Democratic-leaning states like California, Connecticut, New Jersey and New York the hardest. This is a problem for pro-tax Democrats. Enter New York Representative Jerrold Nadler, who wants to exempt his own six-figure constituents from the tax hike he supports. Mr. Nadler’s bill would “require the IRS to adjust tax brackets proportionally in regions where the average cost of living is higher than the national average.” In other words, the various tax brackets would apply to residents in certain regions at higher income levels versus other parts of the country. A family with an income of $50,000 or even $1 million in Manhattan would pay less federal income tax than a family with the same earnings in Omaha. The bill is called the Tax Equity Act, but a more accurate title would be the Blue State Tax Preference Act. Hmmm. Why is it so expensive to live in New York? Oh yeah: That point about “reality” and the tax code could certainly use some fleshing out, but leave that aside. A big reason the cost of living is so high in Boston, Manhattan and San Francisco is because of high state and local taxes, union work rules, and heavy business regulation that make it more expensive to produce, sell and buy things. Why should someone in Spokane or Knoxville or Topeka be penalized because New York and California impose destructive policies? Mr. Nadler also conveniently forgets that the federal tax code already subsidizes high-cost states through the deductibility of state and local income and property taxes.
I heard teachers are exempt from paying income tax, is this true? Since they work for the civil service, they are not liable for income taxes by the federal government. Is this true?
Italian J1 Intern - taxable income? Hi, I would like to get some advice on my current tax situation I have been in the US for 6 months (Sep 2010-Mar 2011) as a J1 scholar, working at UC San Diego, and under the US-Italy tax treaty, all my income was non-taxable at the federal level, and at the state (CA) level, I earned less than 14k$ in 2010 and so was tax exempt there as well Now, I am interning in the US under ANOTHER J1 visa (intern, rather than scholar), again in CA. 1) I understand that my income as intern is NON-exempt under the tax treaty, is that right? 2) Do I need to pay CA SDI tax, or can I ask a refund for that when filing my 2011 CA tax return? If so, how? 3) Can I deduct living expenses from my Federal tax return for a 3-month internship? If so, how? 4) Can I also ask for a refund for Medicare and FICA tax from Federal? Again, how do I do that? Thanks a lot :) I know it may all sound obvious, but it is the first time I actually have to pay taxes in the US and I want to make sure I do it right, without giving away more money than I owe in the process..
What would happen to the economy if Obama gets everything he wants? Obama wants to eliminate taxes for 10 million people, increase benefits for fathers that pay their child support, and increase benefits for low income people that have 3 or more children. For the middle and upper income people, he plans on raising taxes. "Obama has proposed a host of increases that would raise the federal income-tax rate on top earners -- and not just that 1% -- to 52% from 35%, according to an analysis by Investor's Business Daily. That calculation includes applying the 12.4% payroll tax that funds Social Security to some income above the current $102,000 cap, and letting some of President Bush's tax cuts expire. His former rival for the Democratic nomination, Hillary Clinton, has called his plan to raise Social Security taxes "a trillion-dollar tax hike on the middle class." Interest on municipal bonds, however, is exempt from tax, which is why Obama's Northern Trust fund generates tax-free income." Any Ron Paul Supporters Agree With This? http://www.house.gov/paul/press/press2007/pr092707.htm Congressman Paul Introduces "The Tax Free Tips Act" September 27, 2007 Washington, DC - Congressman Ron Paul has introduced legislation that would ease the tax burden on some of America ’s hardest workers – those in the service industry. The Tax Free Tips Act of 2007 H.R. 3664 would exempt tips and gratuities from federal income and payroll taxes. Tips often compose a substantial portion of the earnings of waiters, waitresses, and other service-sector employees. However, unlike regular wages, a service-sector employee usually has no guarantee of, or legal right to, a tip. Instead, the amount of a tip usually depends on how well an employee satisfies a client. Since the amount of taxes one pays increases along with the size of tip, taxing tips punishes workers for doing a superior job! Not only that, but the IRS estimates how much in tips an employee should have received and taxes them based on that. This should stop. “Many service-sector employers are young people trying to make money to pay for their education, or single parents struggling to provide for their children. Oftentimes, these workers work two jobs in hopes of making a better life for themselves and their families. The Tax Free Tips Act gives these hard-working Americans an immediate pay raise. People may use this pay raise to devote more resources to their children’s, or their own, education, or to save for a home, retirement, or to start their own businesses,” stated Congressman Paul.
Should military personal be exempt from paying income taxes? The USA's fighting forces volunteer to defend this great nation. I feel because of this service they should be exempt from paying federal and state income taxes on their income. They provide a service that many of us choose not to perform even though we are able bodied. What are your thoughts? Active Duty Pretty much all personal currently enlisted in the military and on Active duty whether at home or abroad.
Illegal immigration and taxes? I had an interesting thought regarding the illegal immigration problem the other day and wondered what the good folks in this forum would think about it. It seems to me that the primary problem with illegal immigration is not that motivated undocumented immigrants are coming to the US to find jobs, but rather the fact that they use (and feel entitled to) our abundant social services without paying one dime into the system. It is the tax dollars of hard working American citizens that fund our social services and due to their illegal status these undocumented immigrants do not pay taxes. This fact makes addressing the issue somewhat problematic. If you are an illegal immigrant what motivation do you have to change your status when your reward will be that the federal government will begin removing a part of your income in taxes for the privilege? Additionally, it will be harder for you to remain gainfully employed because your employer must also start paying things like workman’s comp, social security, etc… So… how, might you ask, do we get the undocumented work force to begin picking up their fair share of the social services tab? Abolish the IRS in favor of a national at the register sales tax. Food, housing, as well as a modest per individual clothing allowance can be exempted so that the underprivileged will not pay any of their income in taxes. However, if one is purchasing anything other than the basics like food, functional clothing and shelter they are doing OK from a financial perspective. With such a system everyone who lives in this country regardless of legal status will pay for our social services in proportion to the benefits of society that they enjoy. In other words, such a system is naturally progressive in that poor folks will purchase very little other than the basic tax exempt items and will pay little or nothing while those who have more to spend will pay more. With such a system the financial penalties involved with becoming a legal citizen are removed and the motivation becomes one of legal protection. If one wants the full rights of a citizen, then become a naturalized citizen. If one wishes to remain illegal, then at least one will foot some of the bill for the infrastructure with every purchase of a “Viva Mexico” phone card, six pack of beer, or other non-essential item so abundant in our retail outlets. So… whatdoyathink?
what is the non-exempt portion of your federal income tax refund? i have had to file bankruptcy and the u.s bankruptcy court states i have to turnover half of the non exempt portion of my 2007 state and federal income tax refunds. spoke with lawyer, and he told me that its basically half, but failed to answer my question.
Do you like any candidate for whom you would never vote? This is one of the rare times that I really like a candidate but I could never "pull that lever" for him in a national election (although I would consider him as a legislator). I really like Ron Paul the man,. and I can easily understand why he is getting a lot of buzz. He is very thoughtful and personable and truly seems like a real nice guy. He has personally responded to me and I am not a Republican, libertarian or even in his district. I know what his viewpoints are but I just don't agree with some of his views on gov't. Of course, I agree with him about the folly of the Iraq conflict and that only Congress should declare war, and I wouldn't mind replacing the federal income tax with a national sales tax that would exempt food, fuel, non-luxury clothing and shelter so that the poor is overburdened from the transition. Are there others who have a similar take on this or other candidates? Not being able to vote doesn't count. My question assumes that you DO have the ability to vote for that candidate and it doesn't have to be a current candidate for this year's election. A couple of good answers so far, I give it another day or so and put it up for a vote.
do people sacrifice performance for stability with government programs? Government is run like a big corporation with no limits on debt, no competition, a CEO who cannot be fired except every 4 years, unlimited access to revenue via money printers and mandatory payments by some Americans. It makes sure that it keeps enough other Americans happy by exempting them from having to pay federal income taxes so that they just nod off and fall asleep when it talks about raising more money from the unlucky achieving class. It promises a bunch of "free" services on the backs of people who can still afford to pay for them, so that in the end, it is simultaneously demonizing and dependent on the people who can still somehow pay the bill for it all. How many scandals and overpaid salaries can be hidden in a yearly budget as large as the government.
If exempt was marked on my W-4 by mistake, what actions should my employer have taken.? I recently got my W-2's from my employer and noticed that no federal income tax had been withheld. When I asked about tjis, my employer stated that I had marked exemp in the box on my W-4. This was done totally in error. I have been working since I was 15, I am not stupid enough to try and get one over on the IRS. How should this be handled? They are saying that it is my fault and they can do nothing about it. Please advise.
Is mortage interest exempt from state income tax? Everyone knows that mortgage interest is deductible from income for federal income tax purposes, but is the same true for state income tax? Any websites that clearly state this? Thanks!
Am I required to have Federal Income Tax withheld from my pay? If I claim exempt from withholding, do I still need to file Federal Income Tax return and pay taxes?
pre existing conditions and below the poverty level income obama health care got you covered? Immediate Changes These are the changes that Obama and team call the “early deliverables,” because they would kick into effect as early as six months after the bill is signed into law. Here are a few. The uninsured can finally get coverage: Adults who have been denied coverage because of preexisting conditions will be able to sign on to a federally subsidized insurance program that is due to be established within 90 days. This stopgap insurance program, whose coverage isn’t expected to be comprehensive, will expire once new insurance exchanges start operating in 2014. Coverage for everyone: Insurance companies will not be allowed to drop people from coverage when they get sick, nor can they make health plans vastly more expensive for people with preexisting conditions. Lifetime limits on the amount of health care an insurer will pay for will be eliminated, and annual limits will be restricted. Coverage for kids: For parents with a sick child, there’s some relief—companies won’t be able to drop kids under the age of 19 from coverage because of pre-existing conditions. Parents can also keep their kids on a family plan till they turn 26 or get a job that offers them benefits. Closing the doughnut hole: An estimated 4 million Medicare beneficiaries who hit the so called “doughnut hole” in the program’s drug plan (the gap in coverage which currently begins after $2,700 is spent on drugs) will get a $250 rebate this year. The cost of drugs in the coverage gap will then drop 50 percent next year, and the hole will be closed entirely by 2020. Tax credits for small businesses: For small businesses with fewer than 25 employees and average wages of less than $50,000, the government will provide a tax credit of up to 35 percent of the cost of healthcare premiums so that they may provide coverage to their employees. Short-Term Changes (2011-2014) Free annual wellness visit for Medicare beneficiaries: Medicare beneficiaries will get a free annual wellness visit, and the new health plans will be required to cover preventive services with little or no cost to patients. Medicare will also provide 10 percent bonus payments to primary care physicians and general surgeons. New Medicaid program for poor: A new Medicaid plan for the poor will allow states to provide more home- and community-based care for disabled people who would otherwise require institutional help. Long-Term Changes (2014 onwards) Get insurance or face penalties: Beginning in 2014, all Americans would be expected to get insurance or face penalties. The fine depends on household income, but there’s also an upper limit; a family would pay a maximum of $2,085. Extremely low-income people will be exempt from the fines. Large employers must provide insurance: Big employers are also expected to provide coverage to workers or face fines. Businesses with 50 or more workers who do not provide coverage will be fined $2,000 for each uninsured employee. Extending Medicaid to cover low-income families: Medicaid, the state-federal program for the poor and disabled, will be expanded sharply starting 2014; it will now offer care to people with annual incomes less than 133 percent of the poverty level ($29,326 for a family of four). Tax credits for low-income families: People with incomes up to 400 percent of the federal poverty level will receive tax credits on a sliding scale relative to their income to help them to buy insurance. Buying insurance on state exchanges: State-based insurance marketplaces called exchanges are expected to go into effect in 2014, where people can pick and choose the plan that works best for them. Once the exchanges are up and running, insurers will be barred from rejecting applicants based on their health status. The new policies sold on the exchanges will be required to cover not just hospitalizations, doctor visits, and prescription medicines, but also maternity care and certain preventive exams.

are retired federal employees exempt from GA state income tax? I am a retired federal employee from Illinois who now resides in GA. I do not work so I do not have GA state income to report. Do I have to pay GA tax on my pension?
How does Capital Gains Tax work? I am a student with no income other than investing, and I am curious how capital gains taxes work. Say I started the year with 10,000 invested, and through many trades, within that year, I end up with 15,000 in my account. Am I charged the capital tax on every single trade, or is it just charged on the final profit amount of $5,000? Also, If i have no income other than investing, and my profit falls under the federal exempt tax status, do I still have to pay capital gains tax? One more thing, what is the name of the form to fill out capital gains taxes? Thanks! Does my broker keep track of all my trades? I have no idea how many i have made, however I am up 28%! So there is a capital gains tax for state on top of the federal?
What are your thoughts on removing Federal income taxes? I was listening to a program yesterday on a new propsal to remove the Federal income tax and instead have a federal sales tax of 23%. I personally thought is sounded great! Imagine taking home your entire paycheck!! No IRS. As long as the current exempt items are kept the same, the middle class and poor could really make out. What are your thoughts?
Exempt from Federal Taxes....Will I still Recv a Refund for 07? Ok, here is my predicament. I filed exempt on my tax forms like I do every year with 1 exemption thus preventing Federal Taxes from being taken out of my paychecks and ONLY Fica/Med/State taxes being taken out...I am currently a part-time student that works full-time and only 20 yrs old this would be the 1st time I could file taxes without someone else being able to claim me. My gross income for this year was 23,275 and I fall into the 15% tax bracket. Will I still get a refund for 07 or would I owe money?
I’m looking to invest in a fund offering tax free income - any suggestions? Specificlly, I’m looking to invest in a fund that is diversified, short-term, tax-exempt money market or insurance fund. The fund objective must be to provide a high level of current interest income exempt from regular Federal Income tax to the extent consistent with preserving capital (and California State taxes if available), while maintaining liquidity, and stabilizing principal. I'm open to serious suggestions. Thank you for your time.
Questions about Federal/State Income, Unemployment, Social Security, and Medicare taxes for employee of LLC? If an employee claims that they're "Exempt" from withholding on their W-4, does that mean nothing is removed from their paycheck, or are Social Security, Medicare, and unemployment (Federal and State) taxes still taken out separate from income taxes? If not, is the employer still responsible for paying their share of those taxes? A little background: I'm the organizer, and soon to be manager/employee, of a Limited Liability Company that's going to be formed in the summer of 2009. There will be 3 members; 1 who lives in my state where the company will be formed, and 2 others who live in two different states. The members will be "silent partners", while I will be running the company as the sole manager/employee. Based on the starting year's salary I'll be receiving (minimum wage, part-time), I believe I will be exempt from income taxes and will still receive the EIC, so the IRS will owe me, not the other way around. From the research I've done, I'm pretty sure my state return will be the same. However, I really don't want to get in trouble if Federal and State unemployment, Social Security, and Medicare taxes aren't included as part of "Exempt" status for income tax withholding. Furthermore, I have also considered minimally buying into the company (1-5% membership/ownership interests) in order to get around the whole employee thing, since I've previously dealt with being self-employed, though as an owner-manager of the company, I wouldn't actually have to pay myself a salary if I didn't want to; I could just make my money from the profits like the rest of the members and focus on running the company, rather than on all these complicated tax issues. However, if I do that, I'll be paying out money, instead of receiving it, in order to buy into the company, and I'll be making a lot less money in the beginning, since I'll only be getting a tiny percentage of the profits at the end of the year, rather than a steady monthly salary as I go along. I've read half a dozen library books on forming an LLC and running a small business, and read and downloaded every applicable form/publication from the IRS Web site and my state's Web sites, and I still haven't been able to figure this one out. Any help would be appreciated, even if all you do is point me to a new source of information. Thanks for taking the time to read this, Kodi Type of LLC? Partnership Type of business? Home renovation/real estate investment. I'll be the one doing all the work, but I don't have any capital, so my adopted sisters and life partner will be providing the money. One of my sisters (and my wife) has already agreed to "gift" me the money, but I decided to look into making it an investment, so I don't feel like such a sponge. A further detail that complicates things: I'm on SSI, which puts a limit on how much income and resources I can have. As an employee, I can't make more than a certain amount. As an owner, my share can't be too much. At least not until I can make enough money to support myself without the monthly SSI payments. So, I'm trying to figure out which is better: an employee on payroll or an owner/partner with a share in the profits/guaranteed payments. Figuring out the tax implications of those two states is part of my decision-making process. PS Thank you all for your answers. You've been very helpful.
Will people who do not pay fedreal income tax still get 13 dollars a week extra on their paychecks? I am exempt from federal income tax. 0 dollars are taken out of each of my paychecks and I do not have to pay anything at the end of the year because I have 4 children and do not make enough money to owe any taxes. I do have a full time job. Will I still see an extra 13 dollars a week on my paychecks, or will I not because I do not have any federal income tax to reduce?
Why do scientists working in Antarctica have to pay US federal income tax? I studied geology for a few years and know a geologist who is currently working in Antarctica. I also previously lived and worked overseas and know that for American expatriates, the first $70,000.00/yr is exempt from Federal income tax because expats are responsible for paying local taxes in a foreign country. From what he says, however, he must pay and said it was because per the United States Tax Code Antarctica is not a foreign country, therefore it is exempt from the Foreign Earned Income Exclusion. http://www.irs.gov/businesses/small/international/article/0,,id=97130,00.html Last I heard, Antarctica was not a part of the U.S. Do Russian, French or scientists from other countries who are working in Antarctica have to pay taxes to their homeland? Izzy and Ralph... FYI.. he isn't complaining about paying taxes. It just occurred to me that it didn't make sense, so I asked the question. perhaps a better question would be why does the US Tax Code not see Antarctica as a foreign country? Bostonia... that answers my latter question.. thanks exactly my question v.b. in the harshest of conditions, too. Between the two federal agencies, geologists seem to be between a rock and a hard place ;)
Do most people choose to have their income taxes withheld from their unemployment checks? This is an important question because the year 2008 saw more people receiving unemployment benefits than any year in recent memory. Here's the dilemma: none of the 50 states automatically withhold income taxes from an individual's unemployment benefits. To have income taxes withheld, the claimant must fill out an authorization form and mail it in to their state's unemployment bureau. The problem is that most people don't do this, either because they don't know that unemployment benefits are taxable (i.e. they don't read the directions) or, because they simply can't afford to have taxes withheld from their meager unemployment checks. In most states, unemployment is equal to approx. 50% of a person's weekly salary. A person who earned $40,000 a year ($800 a week) would qualify for about $400 a week from unemployment, BUT many states cap unemployment at $350 or less. Mississippi for example, has a cap of $230. California's is about $360 if I remember correctly. Try living in somewhere like San Francisco on $360 a week. Is a person going to have income taxes withheld from that? I don't think so... Side note: President Obama's proposal to exempt the first $2800 of unemployment benefits from federal taxation does not apply to income tax returns filed for FY 2008. (and of course, it doesn't bar the individual states from continuing to levy taxes on these benefits). All of this means that a lot of people are going to owe the IRS "mucho dinero" during this tax season. With the recession going on, what is going to happen??? Are people going to file grievances with the IRS??? Are people simply going to default on their tax payments??? The filing deadline is almost six weeks away...
I am employed oversea and my employer is taking Federal Tax from my income. Is he correct in doing that? Overseas earnings up to $80,000 dollars is supposed to be tax exempt. Is there any exception?
The amount of Social Security benefits received by an individual that he or she must include in gross income:? Is dependent upon the individual’s contributions to the Social Security program. May not exceed 50% of the Social Security benefits received because the employee paid one-half of the cost May be as much as 85% of the Social Security benefits received Is $0, because Social Security benefits are exempt from Federal income tax None of the above.
Is my US income exempt from the australia/us treaty? Please Help!!? A arrived in the US last year on an e-3 visa from australia. I was only in the country 182 days last year which makes me a non-resident alien for tax purposes. My total income in that period from my job in san francisco was $21000. Only $98 is federal tax was withheld. Does the tax treaty mean i dont need to pay any federal taxes or does the treaty only cover part of it. Any advice would be great.
My employer claims a need a letter from IRS to claim exempt from withholding. Are they pocketing my "taxes"? I claimed exempt (from withholding) on my W-4. To my surprise federal and state income taxes have been taken from my checks. I contacted payroll to inquire. They said I need a letter from the IRS stating that I'm eligible for exemption. I could not find this requirement on the IRS web site's directions for completing W-4s. What gives? Is my employer pocketing the withheld taxes? Wouldn't they have to fabricate my W-4?
how do you report on your taxes a college savings bond (IL) whose interest is tax exempt (from a 1099-b)? Of course, I want to make sure that the interest remains not taxable. I must not be filling something how because both taxcut and taxact simply put 2500 in the taxable interest field. Where is the part about tax exempt? extra points if you could tell me step by step , line number by line number what to put. details: in 1994, we bought a 'ST OF ILLINOIS COLL SVG BD ' for 2500 that had a maturity value of 5k. at maturity, in 2008, we cashed it in for 5k. http://www.state.il.us/budget/bonds.htm it said it was tax exempt - it still says this http://www.state.il.us/budget/bonds.htm#q2 What are the advantages of investing in Illinois College Savings Bonds? Interest on the College Savings Bonds is exempt from both federal and State of Illinois income taxes. i think i have my answer - it is to use line 8b on 1040. http://en.allexperts.com/q/Tax-Law-Questions-932/Form-1099-B-2.htm now i need to determine how to get taxact to do this. probably will be another ya question.
Are minors exempt from paying taxes? If an individual is under 18 can they be exempt from paying federal and/or state taxes; regardless of income? I don't remember paying taxes when I was 15, 16 or 17.
Why have churches sold out to the government? Obtaining Corporation Status (501c3) is Against God The word "church" is not meant to refer to any physical building, but refers to the worldwide body of believers in Christ. The word "church" (ecclesia in Greek - called out ones) does not refer to any organization, no matter it's name or legal status. Keep that in mind when reading this article. It is time for Christians to wake up and turn back to God. We need to turn to the Lord and repent of our sins that we have committed against Him. We need to ask for forgiveness of tolerating idolatry that removes His Sovereignty over His Church. To see that the Church is in grave danger we must have a clear understanding of what a corporation is. We also need to realize what the courts have ruled about corporations and that a corporation has no rights, only privileges, granted by the "estate." To become a corporation removes the authority of the Lord over a corporate church and puts it under the bondage of man's law. According to man, The State is Sovereign over its Corporations 1. "A corporation is a creature of the state. It is presumed to be incorporated for the benefit of the public. It receives certain special privileges and franchises and holds them subject to the laws of the state and the limitation of its charter. Its powers are limited by law. It can make no contract not authorized by its charter. Its rights to act as a corporation are only preserved to it so long as it obeys the laws of its creation. There is a reserved right in the legislature to investigate its contracts and ascertain if it has exceeded its powers" (Hale v. Henkel, 201 U.S. 43) 2. "[A corporation is] an artificial person or legal entity created by or under the authority of the laws of a state. An association of persons created by statute as a legal entity.... The corporation is distinct from the individuals who comprise it (shareholders).... Such an entity subsists as a body politic under a special denomination, which is regarded in law as having a personality and existence distinct from that of its several members." Black's Law Dictionary West Publishing Company, 1991; 6th Edition, page 340. 3. "A corporation derives its existence and all of its powers from the State and, therefore, has only such powers as the State has conferred upon it. Power is used here to mean the legal capacity to execute and fulfill the objects and purposes for which the corporation was created, and the source of this power is the charter and the statute under which the corporation was organized." Len Young Smith and G. Gale Roberson, Smith and Roberson's Business Law, West Publishing Company, 1966, page 796. A corporation derives its existence and all of its power from the State. The church on the other hand was created by and is the body of Christ. We belong to Him and we are subject to Him and His Laws. The source of any church's power is supposed to be the Holy Spirit; it's authority to function solely from God. 4. "Corporate existence is a privilege granted by the sovereign upon compliance with specified conditions" Len Young Smith and G. Gale Roberson, Smith and Roberson's Business Law, West Publishing Company, 1966, page 931. . 5. "Corporations are not citizens.... The term citizen... applies only to natural persons... not to artificial persons created by the legislature" Paul v. Virginia, 8 Wall. 168, 177; see also the Opinion of Field, J., in the Slaughterhouse Cases, 16 Wall.36,99 The Word of God teaches us that Christians, His Holy Church, are citizens of the household of God (Eph.2:19). 6. Every corporation has obtained a charter from the State of Incorporation. This charter is simply permission to exist given to the corporation (by the State!) without which, its operations would be considered illegal. In addition to the charter are the articles of incorporation: "The objects or purposes for which a corporation is formed are expressly stated in its articles of incorporation, which delineate in general language the type of business activities in which the corporation proposes to engage" Smith and Roberson's Business Law, West Publishing Company, 1966, page 798. 7. "Instances of non-profit corporations are educational institutions, athletic clubs, library clubs, fraternities, sororities, hospitals, and organizations which have exclusively a charitable purpose" Smith and Roberson's Business Law, West Publishing Company, 1966, page 789. (Note: The purpose of the church is not "charity," nor is it's purpose exclusively charitable. Charity should be a function of every church, but is certainly not it's purpose. Offering worship to God, evangelism to the lost, and the fellowship and equipping of the saints are among church's exclusive purposes. (gm) The Lord is Sovereign over His Churches : Jesus is the Head of the Church, not man Paul compares the special relationship of Christ and His church to the God giving relationship of man and wife. What can be closer or more special then this? Would you bring another person into your marriage to control it with worldly principles? I hope the answer is no. Then why would you bring in a "fictitious entity" no less created by the state and man i.e.: corporation, to run and regulate something that belongs to the Lord? The relationship with Jesus and His Church belongs to Him alone. He is the Head of the Church and as such He governs it with His Laws, Principles and Directions. After all He is our King and is Sovereign over His Church. To become a corporation in effect divorces the church from Christ. We also commit idolatry by putting something before Him. Eph 5:23 For the husband is the head of the wife, even as Christ is the head of the church: and he is the saviour of the body. Christ is the Saviour of the body (the church); not the state. 24 Therefore as the church is subject unto Christ, so let the wives be to their own husbands in every thing. The church is subject to Christ not the state. 25 Husbands, love your wives, even as Christ also loved the church, and gave himself for it; Christ has purchased the church with His own blood. The State can give nothing for the church and should give nothing to the church. 26 That he might sanctify and cleanse it with the washing of water by the word, 27 That he might present it to himself a glorious church, not having spot, or wrinkle, or any such thing; but that it should be holy and without blemish. The church should be holy and without blemish, to mingle the church with the state/worldly system is to bring spot and wrinkle to the church because of what the state/world does and says, homosexuality, abortion, adultery and many other things are acceptable, they pass laws making them that way. This goes against God; should the church be partakers of that? 28 So ought men to love their wives as their own bodies. He that loveth his wife loveth himself. 29 For no man ever yet hated his own flesh; but nourisheth and cherisheth it, even as the Lord the church: The Lord nourishes and cherishes the church. Throughout history the state has tried to destroy the church. It still does through legislation trying to control all aspects of the free and corporate church. 30 For we are members of his body, of his flesh, and of his bones. The church is a living organism with a living head and body. Therefore the church is not a religious organization. It is possible to be a religious or charitable organization without being a church. 31 For this cause shall a man leave his father and mother, and shall be joined unto his wife, and they two shall be one flesh. The church is to be joined unto Christ. In Matthew Jesus used the word cleave. I do not see that the church is to be joined to Christ and the state. 32 This is a great mystery: but I speak concerning Christ and the church. He speaks of the relationship that the church is supposed to have with Christ. One that is supposed to be holy and true. One, that's with each other without interference, blessed. Eph 1:20 Which he wrought in Christ, when he raised him from the dead, and set him at his own right hand in the heavenly places, 21 Far above all principality, and power, and might, and dominion, and every name that is named, not only in this world, but also in that which is to come: 22 And hath put all things under his feet, and gave him to be the head over all things to the church Christ is to be all things to the church. He is in Charge and Head of the church not the state. The state is under His feet, it is the footstool of the Lord why put it ahead of Him? 23 Which is his body, the fullness of him that filleth all in all. KJV There are more Scriptures that would support that Jesus is the sole authority over the church. Most of us Christians know this and believe this. I challenge my brothers and sisters to find them. Study them, to see if the Truth is being brought forth. Jesus Christ Should Be The Head Of The Church - Why Then Incorporate? Many people for some reason think that a church has to. This is far from the truth on a few different levels. Here in the United States of America a church does not have to incorporate at all to be recognized as a local body of believers. (Not sure why they would want recognition from the state anyway.) I know some of you are thinking "Well, Romans 13 says..." Most of us have been taught that whatever the government says, goes. Wrong! If the government passes a law that interferes or contradicts one of Gods law we are not bound to follow it. There are examples of this in the Bible ; we have all heard the story of Daniel and the lions' den. To think Christians are bound by the laws of men, when it comes to the work of the Kingdom, is just stupid. If this were the case the church in Russia, China, Middle East and other places - if they listened to Romans 13 the way it is applied now - would never have seen growth. How about the brothers/sisters that smuggled Bibles into the old Soviet Block, China, Cuba and others? Whose law did they break? Man's. The local government's. They may be held accountable for their actions by men, they might even lose their lives. Guess what? God will reward them for their actions. They were doing the work of the Kingdom. I know most of us have heard that Federal law supercedes state law. State law supercedes county, city and town law, and so on and so forth. Guess what? The law of God supercedes all of man's law when it goes against His own (Acts 4:18-19). The point is even if there was a law requiring churches to incorporate we would not be bound to do so. In doing so we would be removing the Lordship of Jesus and giving it to the state. Thank God we have not reached this point yet in this country but don't be fooled, its coming. Why then do churches incorporate? 1. They think they have to. 2. They feel it gives them some benefit. 3. They think it gives them prestige. 4. Asset protection. 5. Think it's the only way gifts are tax deductible. 6. Think its okay with God. 7. They have always done it that way. The list could go on, I'm sure we could all find some earthly reasons why we think incorporating would be a good idea. We Still Think It's The Law - Show me Otherwise If you still think it's the law and that would make any difference to you in your relationship with the Lord, I will show you differently: "Congress shall make no law regarding an establishment of religion, or prohibiting the free exercise thereof" (U.S. Constitution, First Amendment). According to the Internal Revenue Code, "a church, its integrated auxiliaries, and conventions and associations of the church are excluded from taxation." United States Code, Title 26, 508(c)(1)(A). Section 508(c) of the Internal Revenue Code provides that churches are not required to apply for recognition of Section 501(c)(3) status in order to be exempt from federal taxation or to receive tax deductible contributions. Churches are automatically exempt from Federal income tax, and contributions to churches are deductible by donors under section 170. Elsewhere, the IRS states: "Although a church, its integrated auxiliaries, or a convention of churches is not required to file Form 1023 to be exempt from federal income tax or to receive tax deductible contributions, such an organization may find it advantageous to obtain recognition of exemption (Tax Exempt Status for Your Organization, IRS Publication 557). Just what "advantage" is there for a church in obtaining 501(c)(3) recognition and thereby exchanging its sovereignty for a subordinate status in relation to the federal government? Most people would answer that such grants the church exemption from taxation. However, we have already seen that the federal government has never been able to tax the Church of Christ; the Church is not exempt from taxation, it is immune. The "advantage" is something else entirely: "By establishing its exemption, potential contributors are assured by the [Internal Revenue] Service that contributions will be deductible" Tax Exempt Status for Your Organization, IRS Publication 557. The tragic irony of all this is that, according to the Internal Revenue Code, financial donations to an unregistered, unincorporated church are automatically tax-deductible (26 USC 170-B). The government has no constitutional authority over the Church. It is not allowed to violate the First Amendment protection that the constitution provides. In fact the government may not infringe on any of our constitutional rights at all. They have found a way around this of course. To hold out an unbiblical advantage hoping an ignorant clergy person will take the bait and bring the church into voluntary compliance by forming a 501( C )(3) corporation, thus placing the church under the authority of the state. Once the church has been transformed into a corporation it then becomes subject to control by federal and state governments. In truth an incorporated church is no longer a church!! but merely a non-profit organization. Once a church incorporates the new non-profit organization is subject to total control by the government. You will be controlled on who you hire, what you can and cannot preach. You cannot conflict with public policy nor assault the hearer's sense of mental well being, self-esteem, sexual orientation etc. You can be sued. The IRS prohibits such organizations from "carrying on propaganda, or otherwise attempting to influence legislation" (26 USC 501-C-3). This prohibition extends, not only to the endorsement of a political candidate, but also any other attempts to "influence legislation," including taking a public stand against such government-protected abominations, such as abortion or homosexuality. Now, the church is discovering that favors from Washington, DC have strings attached. In this case, the string is a rope that is being used to throttle her once-powerful voice, to squeeze out her very life and, eventually, to hang her by the neck until dead! History Of Our New Nation: One of the reason people came to the new land was to get away from the entanglements of the old world. Quite a few of the reasons dealt with the issue of church and state. People where fleeing a repressive regime where there was a state-sponsored church or the church was running the governments. It was bad enough that people picked up and left. Now we seem to be returning to what our forefathers left on our own free will. We are taking a license to preach from the state, being told what we can and can't say. One of the things that inspired Patrick Henry's speech "Give Me Liberty Or Give Me Death" was, he saw a man being beaten for preaching the gospel without a license. If we forget history we are doomed to repeat it. We as Christians need to wake up and take a stand. One thing that sticks in my mind is when I got married : "By the power vested in me by God and the State of California I now...." What Do I Do Now? (This section will not be favored by corporate Pastor/Ministers.) 1. You became incorporated, become unincorporated. 2. Talk to your Pastor/Minister about this important issue. 3. Rescind your membership in an incorporated church. 4. Don't incorporate. 5. Don't support incorporated churches. 6. Find an unincorporated church. 7. Start an unincorporated church. 8. Study Your Bible Daily. 9. Pray for the Body of Christ. 10. Witness and lead people to a personal relationship with Jesus. I know finding an unincorporated church will be a real chore, as there are not many out there. There is also a real need to hear and study the word. If you must go to an incorporated church I suggest not becoming a member. I know this is not the norm but we have to remember who the head of the church is, and especially, that we are not join to ourselves to a harlot. Churches which have (knowingly or not) substituted the authority of Christ with sinful man's demonically-influenced word system fit this description. This issue has weighed on my spirit for a long time. I'm guilty of idolatry for finding things to put before Him in the writing of this paper. I was led to write this and now it's almost done. I only pray that God will get the glory, eyes and hearts will be opened and His Will be done. I realize this paper will not make me many friends. I know this, but that was not the point. I pray people will take the time to search out what The Word has to say on this issue. I'm certain many people will come to the same conclusion and we can restore the Lordship of Jesus Christ to his rightful place over HIS church. Acts 17:11 These were more noble than those in Thessalonica, in that they received the word with all readiness of mind, and searched the scriptures daily, whether those things were so. What happens if your company stops taxing your income due to a keyboard error? My company made me salaried. The payroll clerk exempted my income from Federal taxes. Now I'm faced with a huge tax bill and my company wants to take out the money out of my next 5 checks to help me pay the tax burden.
whats that one law where college students are exempt from tax? i was talking to a guy and he said that there is some federal law. something like because he was in college he did not have to pay income tax
What do you think about this idea? Have the Federal Tax rate set at 15% for everyone and exempt the first $30,000 in income from taxes. Also set the tax rate for all other income at15% (dividend, investment, interest and so on) Set the Corporate tax rate at 15% with no deductions or exemptions. Here are some of the benefits I see from this: 1) Less Government intrusion in our lives, they will not need to know what kind of car you drive, what windows you buy, what paint you use and so on 2) Less Lobbying power for large corporations, if they all pay the same rate with no kinds of breaks lobbying would be worthless 3) No more hiding income in tax free investments and other tax avoidance schemes 4) Bonuses, salary all income taxed equally 5) Rich pay more, the poor pay little or nothing 6) Everyone is treated fairly under the law 7) Simplified tax code Do you agree with this plan or disagree, please explain your answer
Is money deposited in a 401k plan tax exempt? My wife started making regular deposits in a 401k plan offered by her new employer in 2006. Question: Is the money she invested in the 401k Plan tax deductible in 2006? In other words, do these contributions count as taxable income....or are they tax exempt? If contributions to 401k plans are tax deductible, is there a limit to what we can claim on our federal income tax form each year if we file a joint return?
Is this then treated as income on my 2008 Federal Tax Return? Suppose that I receive $1,200 tax rebate under the Economic Stimulus Act of 2008. Is this then treated as income on my 2008 Federal Tax Return? Can it be considered as a gift from my Uncle Sam and thus be tax exempt? THIRD
I have a $20,000 Federal income tax exemption. why am I being changed 10% of my gross under "FEDL TAX"? I get paid bi weekly. My first paycheque was for only one week's pay and only 6% was taken out. I got my other paycheque today and 16% was taken out. (6% can be attributed to Pension and EI) The thing is that because I'm going to school I have a Federal Tax exemption (and a provincial one); the total is for 20,000 Fed tax exempt .... why am I getting "FEDL TAX" taken out of my paycheque when I'm supposed to be Fed Tax exempt? P.S. Under my year to date under Federal tax it lists the exact amount of of Federal tax widthheld as this paycheque. So for some reason no Fed tax was taken out last pay, but it was taken out for this pay.
Federal Taxation Problem? Juan was considering purchasing an interest in a tax exempt bond fund for $100,000, when he discovered that the interest must be included on his state income tax return. The interest rate is 15%. his marginal federal tax rate is 35%, and his marginal state income tax rate is 10%. Juan itemizes his deductions on his state income tax return. As an alternative, Juan can purchase a state bond (a double-exempt bond) yielding 4.9% interest that is exempt from both federal and state income tax. Which investment would the greater after-tax return? Help please..
I am retired on social security. Do I have to file taxes for interest earned or am I exempt? I only get social security and interest income from savings accounts and a couple insurance policies. Do I have to file Federal and State income tax or can I simply file exempt? I filed exempt from local years ago.

2007 tax rebate - Will the fed tax rebates be subject to state/local income tax on our 2008 income tax forms? I moved in Jan 2008 from FL (no state income tax) to MD (has state/local income tax) - When I get my $600 federal income tax rebate check for 2007, will I have to report that as income on my 2008 state/local income tax forms, or is the Fed rebate exempt from being reported as income for 2008 ?
California Income Taxes - Foreign Earned Income Exclusion? This question has been mark as resolved: http://au.answers.yahoo.com/question/index.php?qid=20070223165350AAgg2kB However, the page five instructions actually state: If you excluded income exempted by U.S. tax treaties on your federal Form 1040 (unless specifically excempt for state purposes), enter the excluded amount in Column C. If you claimed foreign earned income or housing cost exclusion on your federal Form 1040 (under IRC Section 911), see the instructions for line 21. Therefore, it seems to me that entering the amount into column C applies only if that amount is derived from excluded income due to U.S. tax treaties. But what about the foreign earned income exclusion claimed by filing a federal 2555-EZ? The page 5 instructions state "see the instructions for line 21" but these ARE the instructions for line 21. Is this a typo in the 540CA instructions? Any ideas on how to fill out the 540CA to account for the foreign earned income exclusion?
Income tax or federal sales tax: your opinion? The global economy is putting pressure on our current income tax system. As we buy more goods produced by labor in foreign countries, the federal tax base is shrinking. In additon, there is an ever increasing underground economy that isn't paying tax like many cash business operators(drug dealers come to mind.) Would a federal sales tax make more sense in this day and age? Staples like food and clothing could be exempted to prevent the poor from being unjustly burdened. A federal sales tax would eliminate costly accounting fees paid by taxpayers, collect taxes on imported goods, and force drug dealers and other cash operators to pay their fair share. There doesn't seem to be any downside.
Would you invest in US Govt securities, bills and short term Notes, using Treasury Direct if they...? were made tax exempt from Federal income taxes for the next five years? I see the effect being Americans hold more of the US debt versus foreign investors. Considerations: Full faith and credit of US govt. of getting principal and some return tax free. vs. turkey shoot of current stocks and brokerage instruments. Did not enjoy watching some of my brokerage issued securities tank in last 10 days.
Is all the income for an F1 student from India tax exempt under article 21(2)? Hi, I'm an F-1 student from India in my 4th year. In the previous years I have claimed the standard deduction and personal exemption in my 1040NR EZ forms and have received a partial refund of the total taxes withheld. I know a friend who has claimed that the entire earnings for the year (~20K) is exempt under article 21(2) and has received all the federal tax withheld. Is this legal? Can I claim 100% tax exemption too? I get compensated for teaching as a TA in my school. Thanks in advance.
What does it mean to claim "exempt" on your W-4? Will you not be taxed anything on your paycheck? I work in collections and a couple of my co-workers are claiming exempt on their W-4, because are commission checks are low right now, but there keeping it that way even when we don't get our commission paycheck. Is this a smart thing to do? Last year I got a refund, but I'm sort of confused what its asking me on the next one. "This year I expect a refund of ALL federal income tax withheld because I expect to have NO tax liability."
If an employee requested payroll deduction to Charity (donation), what kind of taxes can it be exempted? 1. Federal Income tax 2. Social Security/Medicare 3. FUTA 4. State income tax (California) 5. State Disability (SDI) (California) 6. State Unemployment (SUI) (California)
Why did my US employer start taking Federal and State taxes off my income after 2 years? US-Canada tax treaty? I am a Canadian citizen going to graduate school in the US and have been working for a stipend for the school for 2 years. I signed a paper when I first arrived about a Canada-US tax treaty that exempted me from paying US federal and state taxes. Now all of a sudden, I see I am having those taxes taken off my paycheck. Any ideas? Anyone know anything more specific about this treaty? Thanks for your help so far! I remember being told somehting about I was exempt for 5 years of being in the US and since I had already been there for 3 years without working, that meant I could only be exempt for 2 more years. I can't find any info on this magic number of 5 years. I DO file income tax in Canada. Am I now getting double-taxed?
How to claim 1098T tuition expense from a fellowship on Illinois IL1040? I am a graduate student filing for myself. I received a fellowship which, according to federal rules, counts as taxable income, except for any amount used as "qualified expenses" such as tuition. On the federal 1040A I am able to, towards the end, deduct money used for tuition via the 1098T form and the Lifetime learning credit. The illinois tax form IL1040 takes the adj. gross income from the federal 1040A, which includes the fellowship income before I deduct the tuition credits. I cannot find in the IL1040 forms where I can claim these same qualified expenses and subtract my tuition from my income. There are special programs for parents through the college savings program if they deposit into those special accounts, but I dont have that kind of control of the fellowship money. The closest I have found is Schedule M line 14 which talks about expenses related to tax-exempt income, but I dont think that is correct. Any help would be appreciated.
Income Tax ~ Exemption problem? When I originally interviewed for my current job, I didn't mark myself as exempt on my W-4 form. I later found out I was indeed tax exempt, and refiled through my job; however, upon recieving my paycheck today, I find that my check has indeed been gutted by federal income taxes. I complain to payroll, only for them to tell me "We will fix it for next week, but there is nothing we can do about this week's check." With that said, 1) Is there really nothing payroll can do? Is the idea that they already sent the money to the government and so they truly cant adjust the income tax out of my check, or do I just have a lazy bum for a payroll chief? 2) If indeed I can't work it out with my job, how do I get the lost income tax money back in the fastest possible way? It was 150$, which is plenty for a college student.
IRS & Duel citizenship retiries who live out the US for good. Am I exempt from taxing my savings, pension&SS? Please note the point that I have duel citizenship, retired after a long service with the State of WA, which has no state taxes. Still having my savings in the US banks on which I am paying taxes on its interest. The State is deducting federal taxes on my monthly checks, and I have been submitting my annual taxes on April 15 like every American even as I am not living in the US any more. Do I have the right not to pay taxes on these items as long as I am not living in the US, could I be exempt, and if could this be retroactivly? Again please note that I have duel citizenship would this be a reason not to be taxed on my retirement income. Please let me know where I stand from the IRS, what to do and where to start. Hate to bug you but I just wanted to lump all facts in this format once and for all. Thank you. bb.

Would a combination of a federal sales tax and progress tax work? People who earn $100,000 or less account for about $300 billion in tax revenue. If this income bracket were exempt from the progressive tax and a 6% federal sales tax established, there would be about a $500 billion net gain in tax revenue. This would tax middle and lower income (and drug dealers) only on money spent, not saved. Money needed for mortgage payments would not be taxed, as the tax would apply only on the sale of a home. For incomes above $100,000 the current progressive tax could apply with a standard tax credit for the sales tax. This is not a supply side approach. So it's likely never going to fly. But it seems like it would solve the deficit problem in the first year. Drug dealers currently don't pay income tax. A federal sales tax would at least collect tax money on what they spend. That's why I mentioned drug dealers. It would apply to any underground income spent to buy consumer items.
W-4 Claimed 1 and exempt! Hey I was not sure how to file my W-4 form at the time and I claimed 1 and also accidently claimed exempt from withholding. Though my first two checks DID have federal income tax. Does this mean my employers caught the mistake and are not witholding my taxes but are instead using the 1 claim I put?

What taxes get taken out as a part-time student worker (Summer job only)? I am really confused about what taxes should be taken out of my paycheck and what can be avoided. I work at the movies, and I'm getting 20/21 ish percent taken off every paycheck. That includes Social security, medicare, federal income and state income taxes. I'll be making less than 2000 for the entire summer (but I might come back to work during the winter breaks). I'm a full-time student and my parents claim me as a dependent. Can I claim exempt on my paycheck? What taxes do I not actually have to pay? Thanks a bunch.
Question about filing in Arkansas? If you are full year resident, single, under 65, and make less than $7800 in gross income you are exempt from filing income taxes. But what if under the same situation someone can claim you as a dependent? It seems federal taxes will make a distinction, affecting the standard deduction amount. What about in AR tax?

Exemptions, Withholdings, Deductions..? I'm loosing my mind. Everyone keeps saying that if you claim "0" on your w-4 form you will have more withholdings taken out of your check. Doesn't this make you "exempt" from tax? Meaning that there will be no state and federal income tax withholdings tooken out, you'll just have your social security and medicare tooken out. What is the difference between putting the "0" on that form or just writing "EXEMPT" on the line? Ok, I get it now. 0 = max amount of witholdings, and exempt=no fed. and state witholdings. Thanks for all your great awnsers, I really appreciate it!
Does a retail job handle W-4 tax exemptions differently? My wife started working part-time at Target nearly a year ago, and since she's been there she hasn't had *any* federal or state taxes taken out. Ever. She makes less than $800/mo gross pay. When she filled out her W-4 form, she had put "1 - married". (She didn't claim "exempt" or anything.) Her paystub clearly shows "1 - married." This doesn't seem right. I would expect the lower the number of exemptions she claims, the more taxes they would take out of her check each month. I don't encounter this with my full-time job. I claim "1 - married" and I have a lot of taxes taken out of my check each month! Is retail different or does it have to do with her lower income? We're going to call their corporate office to learn more, but any suggestions would be appreciated.
And you wonder why undocumented immigrants dont pay taxes? Posted: July 26, 2007 1:00 a.m. Eastern By Bob Unruh © 2007 WorldNetDaily.com The Internal Revenue Service has lost a lawyer's challenge in front of a jury to prove a constitutional foundation for the nation's income tax, and the victorious attorney now is setting his sights higher. "I think now people are beginning to realize that this has got to be the largest fraud, backed up by intimidation and extortion and by the sheer force of taking peoples property and hard-earned money without any lawful authorization whatsoever," lawyer Tom Cryer told WND just days after a jury in Louisiana acquitted him of two criminal tax counts. And before you consign him to the legions of "tin foil hat brigades" who argue against paying taxes, and then want payment to explain how to do that, he addresses the issue up front. "These snake oil peddlers have conned millions of dollars out of many well-intended patriots and left a trail of broken lives in their wake. … These charlatans should be avoided, not only because they will lead you to bankruptcy and prison, but because by association they discredit those who are telling the truth," he said. The truth, he said, is where he comes in, with the launch of a new Truth Attack website that is intended to build on his victory, and create a coalition of resources to defeat – ultimately – the income tax in the United States. Although the legal citations in the case tend to run the length of paragraphs, Cryer told WND the underlying issue is not that complicated. Essentially, he argued that income is not necessarily any money that comes to a person, but rather categories such as profit and interest. He said the free exchange of labor for compensation has been upheld as a right by the Supreme Court, but that doesn't necessarily make the compensation income. If ever such an argument were to be presented widely, Cryer said, the income to the federal government would plummet. But not to worry, he said, the expenses could be reduced equally by eliminating programs, departments and agencies that also have no foundation in the Constitution. "The Founding Fathers intentionally restricted the taxing powers of the new federal government as a measure of restraint on its size. By exceeding that limited taxing authority the federal government has been able to obtain resources beyond its intended reach, and that money has enabled the federal government to exceed its authority," he said. For example, he said, the Constitution does not empower the federal government to regulate education, or employment, and agriculture, yet it does so. The jury in U.S. District Court in Louisiana voted 12-0 to find Cryer, of Shreveport, not guilty of failure to file income taxes for two years. He had been indicted in 2006 on charges of failing to pay $73,000 to the IRS in 2000 and 2001. The next step in his personal case will be up to the IRS and prosecutors, if they choose to continue the issue, he said. But for the rest of the nation, he's working with Save-a-Patriot, the Free Enterprise Society, Live Free Now and his own Lie Free Zone to spread the message of the truth. "There are three points that are important," he told WND. "There's no law making the average working man liable [for income taxes], there's no law or regulation that allows the IRS to contend that earnings are 100 percent profit received in exchange for nothing, and the right to earn a living through any lawful occupation is a constitutionally protected fundamental right, and it is exempt from taxation." Spokesman Robert Marvin in Washington's IRS office told WND the Internal Revenue Code provides for taxation on salaries or wages, but when pressed for a specific citation, or constitutional provision, he said, "I can't comment." Cryer's encounter with tax law began more than a decade ago when a friend told him the income tax was sham. Cryer started researching, hoping to keep his friend out of trouble. But his conclusions, after years of research, were exactly what his friend told him. He researched not only tax laws, but also the documents pertaining to the drafting of the U.S. Constitution as well as the first income tax. He said throughout his battle, he's offered at every turn to pay taxes if the IRS could show him the authorization, and that never has happened. "The Criminal Investigation Division and Department of Justice both responded only with 'your position is frivolous.' I had never stated a position, so how could they know whether it was frivolous?" he said. "Imagine my sending you a bill for $1,000 and when you call me and ask what the bill was for I simply said, 'that position is frivolous, just write the check and send it in.'" His acquittal, he said, was a precedent because it means "people can see and recognize the truth." He said multiple Supreme Court opinions have affirmed an individual's ownership of his or her own labor, and "exercising your fundamental rights" is not taxable. "It is definitely a trade. What most people receive in the form of wages, salaries or in my case fees that they personally earned for their labor is not received in exchange for nothing." He said there might be a profit that should be taxable, but there might not. "The IRS lets Wal-Mart sell a trillion dollars worth of goods, but they can back out their cost of goods [before being taxed,]" he said. "The IRS considers, in the case of a Wal-Mart wage earner, 100 percent of what he takes in is profit." "But he's using his life, energy and work lifespan, and depleting it as he goes," Cryer told WND. "[Working] is a God-given fundamental right that is protected under the Constitution and can't be taxed any more than exercising freedom of speech." While he waits to see what, if anything, the IRS and Justice Department will do next in his case, he's working to coordinate the groups that are battling taxation as unconstitutional. "I have started a campaign to unify [the work] and we've got a number of organizations that are sponsoring and supporting this campaign," he said. The goal is to get everyone "who is aware of the truth" organized so they can spread the word. He warned without a restoration of constitutional basics, the nation is lost. "Read your Constitution and you will see that the federal role does not include ANY authority to regulate or tax any citizen directly and that WE expressly reserved the right to rule and govern ourselves as States, not as mere political subdivisions," his website says. "The Constitution does not allow the government to run your lives, but the money it is stealing from millions of Americans is the fuel for its over-reaching and kibitzing. Take the money back and we and our states and communities can again be free," he said. Long Story short, income tax is unconstitutional, and yet most undocumented immigrants pay taxes
Help on income taxes!!? Long story short...husband and I made approximately $60,000 in 2007. An error was made and he's been claiming 4 people for 6 months on his paycheck, (I claimed no one through the year). We only have a family of 3 so how 4 people were made exempt is beyond me. We've paid approximately $6540 in federal and $2720 in state. How much are we going to have to pay in? And what will happen if we can only do a payment plan? Do we have to get a lawyer to setup a payment plan? Any info would be appreciated. Also, we don't have any interest on a house we can deduct or anything like that. We file short form as we don't own anything.
I am having issues with my W-4 form since I married. Can anyone assist me with allowances and filing status? I am currently listed as Married with 1 allowance for both Federal and State and I have zero children. It gives me the option on my W-4 to "If married, but withholding at a single rate, select single status." Should I do this? Also, it has a claim exemption on the W-4 as follows: I claim exemption from withholding for 2008 and I certify that I meet BOTH of the following conditions for exemption: >> Last year I had a right to a refund of ALL Federal income tax withheld because I had NO tax liability; AND >> This year I expect a refund of ALL Federal income tax withheld because I expect to have NO tax liability. If you meet both conditions, check 'Exempt' here: Do I qualify to check this box/do I meet both conditions?
homeowners association filing status 1120-H? Do we need to file federal income tax for homeowner association. We beleive that we are exempt organization but how can we find out... thanks for your help
Federal tax deductions for contribution to an international retirement plan (IRP)? I am an "international" employee for my company in the United States (I was originally in the US on an F1 student visa, and now I am on an H1B visa with my employer). As such, this status means that instead of the regular 401k plan that other US employees participate in, my contributions (and my company's matched contributions) are managed in an International Retirement Plan, managed in the UK. I believe this is the case for all employees in the company who are in a similar situation as I am. Other employees who contribute to the 401k plan, have their contributions reflected on their W-2 in Box 12 (?), but my contributions are not reflected on my W-2 - hence my taxable income is higher than it should be. I am quite certain that the contributions I make to the IRP are tax-exempt until I start withdrawing from it. My question:How do I report these contributions on my 1040 so that my taxable income is appropriately reflected? Can the standard softwares/websites do this accurately? That's what my problem is - I talked with my payroll people yesterday, and they confirmed that my W-2 is NOT reflecting my IRP contributions. My "taxable" income is higher than what it would be had my contribution to the IRP been deducted.

Why does my refund drop if i can be claimed as a dependent? I'm working on filing my federal taxes. In 2006, I have a summer job in which I brought in about $5,885, as well as a job on campus (exempt from FICA) that brought in $1025. I also earned $108 in interest income (1099-INT) from my bank. My total federal withholding for the year was $458. I was looking into using H&R Block's tax program to do my taxes...but when I check the box "I can be claimed as a dependent", it knocks my return from $458 to $271. Why? Is there anything I can do?
What are the laws reguarding high school students and W2 forms? I think that my job is cheating me. I am a full time high school student and according to NYS law if you are a full time high school student I should put exempt and these people are saying I'm not eligible for it. So now they're taking out income tax out of my pay check as well as federal and state tax. I should not be paying both taxes and income tax as a high school student. How can I find out what the law is so I can bring it to their faces and tell them a thing or two. Because I am not going to stand for this. Judy...shut up I'm angry. I know that there are some taxes I can't get out of such as medicare and state as well as social security, but income and federal tax should not be in there. It says on the W2 that if you are a full time student put exempt. My sister did that and she is exempt from federal and income. By the way I earm minimum wage and work two days out of the week. What the hell? And the income and federal tax is what's really doing the most damage to my pay check.
Which Federal Forms to file for non profit? I have a non profit organization that had a net income of -590.00 with less than $100.00 of revenue in 2006. This is NOT a 501(c)(3), so it's not a tax exempt company, yet. Which forms do I need to file? I checked irs.gov and under the definition of 501(c)(3), the organization does qualify as a 501(c)(3), but we have not applied for official status, yet. Do we use the same forms as a 501(c)(3)?
Problem with my W-4 help!? Okay here's the situation, last year i made only 9,000 dollars and i didn't have to pay back, i got a refund of 800 bucks back on my income tax. This year i've been only working for 4 months, i put "EXEMPT" on my Federal and "EXEMPT" on my Minnesota State W-4 sheet, is that illegal? I heard you can only put "exempt" on your Federal W-4 only and not your State W-4 sheet. is that true?

Handled himself with enormous courage, dignity, grace, determination, and leadership in the aftermath of the September 11, 2001 hijackings and anthrax attacks. He almost single-handedly held this country together during those searing days: Just three days after the attacks, in his address at the National Cathedral, the President reassured the nation when he said: "War has been waged against us by stealth and deceit and murder. This nation is peaceful, but fierce when stirred to anger. This conflict was begun on the timing and terms of others. It will end in a way, and at an hour, of our choosing." On Friday, September 14, 2001, President Bush visited Ground Zero. Standing on a crushed and burned fire engine atop the smoldering pile at Ground Zero, he put his arm around a retired firefighter who had volunteered to help, and began speaking to the crowd. Rescue workers shouted that they could not hear him. Someone handed him a small American flag and bullhorn. The President spontaneously shouted: "I can hear you. The rest of the world hears you. And the people who knocked these buildings down will hear all of us soon." The crowd roared with cheers and chants of "USA! USA! USA!" Then he raised that American flag and rallied a nation. Killed Clinton's CO2 rules that were choking off all of the electricity surplus to California. 8. Provided matching grants for state programs that help private landowners protect rare species. Defense & Foreign Policy 1. Successfully executed two wars in the aftermath of 9/11/01: Afghanistan and Iraq. 50 million people who had lived under tyrannical regimes now live in freedom. 2. Saddam Hussein is now in prison. His two murderous sons are dead. All but a handful of the regime's senior members were killed or captured. 3. Leader by leader and member by member, al Maida is being hunted down in dozens of countries around the world. Of the senior al Qaeda leaders, operational managers, and key facilitators the U.S. Government has been tracking, nearly two-thirds have been taken into custody or killed. The detentions or deaths of senior al Qaeda leaders, including Khalid Shaykh Muhammad, the mastermind of 9/11, and Muhammad Atef, Osama bin Laden's second-in-command until his death in late 2001, have been important in the War on Terror. 4. Disarmed Libya of its chemical, nuclear and biological WMD's without bribes or bloodshed. 5. Continues to execute the War On Terror, getting worldwide cooperation to track funds/terrorists. Has cut off much of the terrorists' funding, and captured or killed many key leaders of the al Qaeda network. 6. Initiated a comprehensive review of our military, which was completed just prior to 9/11/01, and which accurately reported that ASYMMETRICAL WARFARE capabilities were critical in the 21st Century. 7. Challenged the United Nations to live up to their responsibilities and not become another League of Nations (in other words, showed the UN to be completely irrelevant). 2. Killed U.S. involvement in the International Criminal Court. 3. Told the United Nations we weren't interested in their plans for gun control (i.e., the International Ban on Small Arms Trafficking Treaty).* 4. The only President since the founding of the UN to essentially tell that organization it is irrelevant. He said: "The conduct of the Iraqi regime is a threat to the authority of the United Nations, and a threat to peace. Iraq has answered a decade of UN demands with a decade of defiance. All the world now faces a test, and the United Nations a difficult and defining moment. Are Security Council resolutions to be honored and enforced, or cast aside without consequence? Will the United Nations serve the purpose of its founding, or will it be irrelevant?" We all know the outcome and the answer. 5. Told the Congress and the world, "America will never seek a permission slip to defend the security of our country." Government Reform 1. Improved government efficiency by putting hundreds of thousands of jobs put up for bid. This weakens public-sector unions and cuts undeserved pay raises. 2. Initiated review of all federal agencies with the goal of eliminating federal jobs (completed September 2003) in an effort to reduce the size of the federal government while increasing private sector jobs. 3. Led the most extensive reorganization the Federal bureaucracy in over 50 years: After 9/11, condensed 20+ overlapping agencies and their intelligence sectors into one agency, the Department of Homeland Security.* 4. Ordered each agency to draft a five-year plan to restructure itself, with fewer managers. 5. Converted federal service contracts to performance-based contracts wherever possible so that the contractor has measurable performance goals. Health 1. Strengthen the National Health Service Corps to put more physicians in the neediest areas, and make its scholarship funds tax-free. 2. Double the research budget of the National Institutes of Health. 3. Signed Medicare Reform, which includes: A 10-year privatization option. Prescription drug benefits: Prior to this reform, Medicare paid for extended hospital stays for ulcer surgery, for example, at a cost of about $28,000 per patient. Yet Medicare would not pay for the drugs that eliminate the cause of most ulcers, drugs that cost about $500 a year. Now, drug coverage under Medicare will allow seniors to replace more expensive surgeries and hospitalizations with less expensive prescription medicine. More health care choices: As President Bush stated, "…when seniors have the ability to make choices, health care plans within Medicare will have to compete for their business by offering higher quality service [at lower cost]. For the seniors of America, more choices and more control will mean better health care. These are the kinds of health care options we give to the members of Congress and federal employees. What's good for members of Congress is also good for seniors. New Health Savings Accounts: Effective January 1, 2004, Americans can set aside up to $4,500 every year, tax free, to save for medical expenses. Depending on your tax bracket, that means you'll save between 10 to 35 percent on any costs covered by money in your account. Every year, the money not spent would stay in the account and gain interest tax-free, just like an IRA. These accounts will be good for small business owners, and employees. More businesses can focus on covering workers for major medical problems, such as hospitalization for an injury or illness. At the same time, employees and their families will use these accounts to cover doctors visits, or lab tests, or other smaller costs. Some employers will contribute to employee health accounts. This will help more American families get the health care they need at the price they can afford. Homeland Security, Border Enforcement & Immigration 1. *See Government Reform above. Under President Bush's leadership, America has made an unprecedented commitment to homeland security. 2. Has CONSTRUCTION in process on the first 10 ABM silos in Alaska so that America will have a defense against North Korean nukes. Has ordered national and theater ballistic missile defenses to be deployed by 2004. 3. Announced a 9.7% increase in government-wide homeland security funding in his FY 2005 budget, nearly tripling the FY 2001 levels (excluding the Department of Defense and Project BioShield). 4. Before DHS was created, there were inspectors from three different agencies of the Federal Government and Border Patrol officers protecting our borders. Through DHS, U.S. Customs and Border Protection (CBP) now consolidates all border activities into a single agency to create "one face at the border." This not only better secures the borders of the United States, but it also eliminates many of the inefficiencies that occurred under the old system. With over 18,000 CBP inspectors and 11,000 Border Patrol agents, CBP has 29,000 uniformed officers on our borders. 5. The Border Patrol is continuing installation of monitoring devices along the borders to detect illegal activity. 6. Launched Operation Tarmac to investigate businesses and workers in the secure areas of domestic airports and ensure immigration law compliance. Since 9/11, DHS has audited 3,640 businesses, examined 259,037 employee records, arrested 1,030 unauthorized workers, and participated in the criminal indictment of 774 individuals. 7. Since September 11, 2001, the Coast Guard has conducted more than 124,000 port security patrols, 13,000 air patrols, boarded more than 92,000 vessels, interdicted over 14,000 individuals attempting to enter the United States illegally, and created and maintained more than 90 Maritime Security Zones. 8. Announced the Student and Exchange Visitor Information System (SEVIS), an internet-based system that is improving America's ability to track and monitor foreign students and exchange visitors. Over 870,000 students are registered in SEVIS. Of 285 completed field investigations, 71 aliens were arrested. 9. This week, the US-VISIT program began to digitally collect biometric identifiers to record the entry and exit of aliens who travel into the U.S on a visa. Together with the standard information, this new program will confirm compliance with visa and immigration policies. 10. Eliminated INS bureaucratic redundancies and lack of accountability. 11. Split the Immigration and Naturalization Service into two agencies: one to protect the border and interior, the other to deal with naturalization. 12. Signed the workplace verification bill to prevent hiring of illegal aliens. 13. Established a six-month deadline for processing immigration applications. 14. Information regarding nearly 100% of all containerized cargo is carefully screened by DHS before it arrives in the United States. Higher risk shipments are physically inspected for terrorist weapons and contraband prior to being released from the port of entry. Advanced technologies are being deployed to identify warning signs of chemical, biological, or radiological attacks. Since September 11, 2001, hundreds of thousands of first responders across America have been trained to recognize and respond to the effects of a WMD attack. Judiciary & Tort Reform 1. Is urging federal liability reform to eliminate frivolous lawsuits. 2. Killed the liberal ABA's unconstitutional role in vetting federal judges. The Senate is supposed to advise and consent, not the ABA. 3. Is nominating strong, conservative judges to the judiciary. 4. Supports class action reform bill which limits lawyer fees so that more settlement money goes to victims. Politics 1. His leadership resulted in Republican gains in the House and Senate, solidifying Republican control of both houses of Congress and the presidency. 2. Signed an EO enforcing the Supreme Court's Beck decision regarding union dues being used for political campaigns against individual's wishes. Second Amendment 1. Ordered Attorney General Ashcroft to formally notify the Supreme Court that the OFFICIAL U.S. government position on the 2nd Amendment is that it supports INDIVIDUAL rights to own firearms, and is NOT a Leftist-imagined "collective" right. 2. Signed TWO bills into law that arm our pilots with handguns in the cockpit. 3. Currently pushing for full immunity from lawsuits for our national gun manufacturers. 4. *See Globalization & Internationalism. Traditional Values, Compassion & Volunteerism 1. Endorses and promotes "The Responsibility Era." President Bush often speaks of the necessity of personal responsibility and civic volunteerism. He said, "In a compassionate society, people respect one another and take responsibility for the decisions they make in life. My hope is to change the culture from one that has said, if it feels good, do it; if you've got a problem, blame somebody else — to one in which every single American understands that he or she is responsible for the decisions that you make; you're responsible for loving your children with all your heart and all your soul; you're responsible for being involved with the quality of the education of your children; you're responsible for making sure the community in which you live is safe; you're responsible for loving your neighbor, just like you would like to be loved yourself." 2. Started the USA Freedom Corps, the most comprehensive clearinghouse of volunteer opportunities ever offered. For the first time in history, Americans can enter geographic information about where they want to get involved, such as state or zip code, as well as areas of interest ranging from education to the environment, and they can access volunteer opportunities offered by more than 50,000 organizations across the country and around the world. 3. Established the The White House Office and the Centers for the Faith-Based and Community Initiative — located in seven Federal agencies. The faith-based initiative supports the essential work of these important organizations. The goal is to make sure that grassroots leaders can compete on an equal footing for federal dollars, receive greater private support, and face fewer bureaucratic barriers. Work focuses on at-risk youth, ex-offenders, the homeless and hungry, substance abusers, those with HIV/AIDS, and welfare-to-work families. 4. The White House released a guidebook fully describing the Administration's belief that faith-based groups have a Constitutionally-protected right to maintain their religious identity through hiring — even when Federal funds are involved. 5. Issued an EO implementing the Supreme Court's Olmstead ruling, which requires moving disabled people from institutions to community-based facilities when possible. 6. Increased funding for low-interest loan programs to help people with disabilities purchase devices to assist them. 7. Revised the Department of Housing and Urban Development's Section 8 rent subsidies to disabled people, permitting them to use up to a year's worth of vouchers to finance down payments on homes. HUD has started pilot programs in 11 states. 8. Committed US funds to purchase medicine for millions of men, women and children now suffering with AIDS in Africa. 9. Heeding the words of our own Declaration of Independence, the president laid out the non-negotiable demands of human dignity for all people everywhere. On January 29, 2002, he said, "No nation owns these aspirations, and no nation is exempt from them. We have no intention of imposing our culture. But America will always stand firm for the non-negotiable demands of human dignity." As stated by the President, they are a virtual manifesto of conservative principles: Equal Justice Freedom of Speech Limited Government Power Private Property Rights Religious Tolerance Respect for Women Rule of Law
